Simpson Found Guilty On All Counts Save Email Print

O.J. Simpson, who went from American sports idol to celebrity-in-exile after he was acquitted of murder in 1995, was found guilty Friday of robbing two sports-memorabilia dealers at gunpoint in a Las Vegas hotel room.

The 61-year-old former football star could spend the rest of his life in prison. Sentencing was set for Dec. 5.

A weary and somber Simpson released a heavy sigh as the charges were read by the clerk in Clark County District Court. He was immediately taken into custody.

The Hall of Fame football star was convicted of kidnapping, armed robbery and 10 other charges for gathering up five men a year ago and storming into a room at a hotel-casino, where the group seized several game balls, plaques and photos. Prosecutors said two of the men with him were armed; one of them said Simpson asked him to bring a gun.

The verdict came 13 years to the day after Simpson was cleared of murdering his ex-wife, Nicole Brown Simpson, and her friend, Ronald Goldman, in Los Angeles in one of the most sensational trials of the 20th century.

"I don't like to use the word payback," defense attorney Yale Galanter said. "I can tell you from the beginning my biggest concern ... was whether or not the jury would be able to separate their very strong feelings about Mr. Simpson and judge him fairly and honestly."

Simpson's co-defendant, Clarence "C.J." Stewart, 54, also was found guilty on all charges in the Las Vegas case and taken into custody.

Simpson showed little emotion as officers handcuffed him and walked him out of the courtroom. His sister, Carmelita Durio, sobbed behind him in the arms of Simpson's friend, Tom Scotto, who said "I love you" as Simpson passed by. As spectators left the courtroom, Durio collapsed.

Jurors made no eye contact with the defendants as they entered the courtroom. They declined to answer questions after the verdict was read.

Galanter said his client had expected the outcome, and in a courthouse conversation with an Associated Press reporter on Thursday, Simpson had implied as much.

Simpson said he felt melancholy and that he was "afraid that I won't get to go to my kids' college graduations after I managed to get them through college."

Galanter said it was not a happy day for anybody. "His only hope is the appellate process," he said.

Clark County spokesman Dan Kulin said prosecutors would not comment until the case was "completely resolved."

Judge Jackie Glass made no comment other than to thank the jury for its service and to deny motions for the defendants to be released on bail.

She refused to give the lawyers extended time to file a motion for new trial, which under Nevada law must be filed within seven days. The attorneys said they needed time to submit a voluminous record.

"I've sat through the trial," Glass said. "If you want a motion for new trial, send me something."

Stewart's attorney, Brent Bryson, promised to appeal.

"If there was ever a case that should have been severed in the history of jurisprudence, it's this case," he said of unsuccessful attempts to separate Stewart's case from Simpson's because of the "spillover" effect.

From the beginning, Simpson and his lawyers argued the incident was not a robbery, but an attempt to reclaim mementos that had been stolen from him. He said he did not ask anyone to bring a weapon and did not see any guns.

The defense portrayed Simpson as a victim of shady characters who wanted to make a buck off his famous name, and police officers who saw his arrest as an opportunity to "get" him and avenge his acquittal.

Prosecutors said Simpson's ownership of the memorabilia was irrelevant; it was still a crime to try to take things by force.

"When they went into that room and forced the victims to the far side of the room, pulling out guns and yelling, `Don't let anybody out of here!' — six very large people detaining these two victims in the room with the intent to take property through force or violence from them — that's kidnapping," prosecutor David Roger said.

Kidnapping is punishable by five years to life in prison. Armed robbery carries a mandatory sentence of at least two years behind bars, and could bring as much as 30.

Simpson, who now lives in Miami, did not testify but was heard on a recording of the confrontation screaming that the dealers had stolen his property. "Don't let nobody out of this room," he declared and told the other men to scoop up his items, which included a photo of Simpson with former FBI Director J. Edgar Hoover.

Four other men charged in the case struck plea bargains that saved them from potential prison sentences in return for their testimony. Some of them had criminal records or were otherwise compromised in some way. One, for example, was an alleged pimp who testified he had a revelation from God telling him to take a plea bargain.

Memorabilia dealer Thomas Riccio, who arranged and secretly recorded the hotel-room confrontation, said he netted $210,000 from the media for the tapes.

Similarly, minutes after the Sept. 13, 2007, incident, one of the alleged victims, sports-memorabilia dealer Alfred Beardsley, was calling news outlets, and the other, Bruce Fromong, spoke of getting "big money" from the case.

Simpson's past haunted the case. Las Vegas police officers were heard in the recordings chuckling over Simpson's misfortune and crowing that if Los Angeles couldn't "get" him, they would.

During jury selection, Simpson's lawyers expressed fears that people who believed he got away with murder might see this case as a chance to right a wrong.

As a result, an usually large pool of 500 potential jurors was called, and they were given a 26-page questionnaire. Half were almost instantly eliminated after expressing strong feelings that Simpson should have been convicted of murder.

The judge instructed the jurors to put aside Simpson's earlier case.

In closing arguments, Galanter acknowledged that what Simpson did to recover his memorabilia was not right. "But being stupid, and being frustrated is not being a criminal," he said.

He added: "This case has taken on a life of its own because of Mr. Simpson's involvement. You know that. I know that. Every cooperator, every person who had a gun, every person who had an ulterior motive, every person who signed a book deal, every person who got paid money, the police, the district attorney's office, is only interested in one thing: Mr. Simpson."

VBush..friend..haven't you read enough of my comments to know i don't beat around the the vbush. I"m direct and often my comments don't make it to post. Reverend Wright is a moron, but what am I suppose to do about that, except tell you my opinion. See I believe in karma......EVERYONE will get what's coming to the...good, bad, indifferent! Wright's chickens aren't home YET, but please believe they are on their way! ;)

Twelve jurors gave this moron his chance to become a decent person 13 years ago and he chose instead to flaunt his freedom in front of the families of his victims. Remember that he "vowed" to find the "real killer"? How could he do that when he has lived on a golf course all this time? I don't care what color a person is, murder is murder and what he did to those two innocent victims was horrific! He deserves to get what he gave, but our celebrity obsessed society won't let that happen. I pray that he rots in there so he won't have the chance to hurt anyone else and that they put him in the general population so we don't have to feed him for long.

Obama 08; I hope that the 'chickens come home to roost' comment wasn't a veiled reference to the Reverend Wright.:)

It's been 12 years and he still hasn't found his wife's killer. What goes on in Vegas DOESN'T stay in Vegas!!! The tape tells it all.

Funny how those who were so willing to accept a not guilty verdict in his murder trial are now challenging this verdict.

Posted by: T Location: Washignton on Oct 6, 2008 at 03:53 PM
We all know that if he didn't kill his wife and her lover that he had something to do with it and should have been tried as such. He got off from murder though. He got what he deserved now though. Video doesn't lie. In this case he is guilty as well and deserves to serve his time.

Posted by: ??? Location: NC on Oct 6, 2008 at 03:50 PM
He got what he deserved this time, unlike the first time. No slick talking Johnnie Cockroach this time to weasel him out of it.But of course there are some that have to make a racial thing out of everything that doesnt go thier way.

Who was on the jury? How many whites, how many blacks? Everyone seems to forget that BOTH the prosecutor and the defense attorney APPROVED each juror. So if there were not enough blacks, hispanics, etc. then blame OJ's attorneys. They should have pushed for more ethnicities. Or, maybe that was just a clever ploy to be able to get an appeal. We will all have to want for the sequel to come out.

Kudos to Obama 08!

One would think if a man got away with killing two people,he could keep himself out of trouble with the law.He has FINALLY got what he has deserved.

Sad. The man and his children need our prayers. Glad the judicial system is working. Slow is better than no.

Oh what a great day. This is a day of reckoning for a lot of woman. Let me educate some of you and feel free to google this. Not all black people are OJ fans nor Nicole. See OJ was married before and he cheated on his first wife with Nicole. Did you even know he was suppose to be watching his son but he left to see Nicole and his first wife found their baby in the pool dead. So when OJ killed Nicole a lot of woman felt like it was karma. Nicole wanted him so bad she would cheat with a married man, WELL she got him....how did that work out for her? His first wife is still alive. 14 years later OJ finally gets his. Chickens coming home to roost. Plenty of black people knew OJ was guilty then like he is now. OJ's first wife finally gets her pay back. I hope she laughs long and loud. To all the women that have been cheated on, let this story be your inspiration.....it may take 14 years but you will be redeemed.

Anonymous @ Hope this helps: I would like to think if I were on a jury that I would not convict a person because of race. I would like to think I am a bigger person than that. Taking away a persons freedon (or life) is not something to be taken lightly, no matter the persons race or crime, but justice must also be served.

Posted by: Little Woman on Oct 5, 2008 at 10:55 AM
OJ proved what happens in Vegas does not stay in Vegas. Maybe we can prove to him, who goes to prison stays in prison. We will be killing two birds with one stone. Nicole and Goldman this one is for you complements of OJ, sorry it took fourteen years. "REST IN PEACE"

Posted by: XXX Location: Greenville on Oct 5, 2008 at 10:11 AM
Oh how your stories will change. Where are all the people that said oj was setup by the white police and said it was a drug deal gone bad? Now you say he IS guilty.

Posted by: Cat Location: Gboro on Oct 5, 2008 at 09:32 AM
Some would say that the race card is what got him out of the murder of his wife.. I guess that was ok though. Its just when it can be percieved that the race card is what got him convicted, that people start griping! Who cares what color he is? He committed a crime! Get over this stupid race crap!

Posted by: someone Location: rocky mount on Oct 5, 2008 at 03:10 AM
I am African american women and who cares about him,I think he just continue on hanging and with the same so called friends, and he and everyone who hates him finally got what he wanted. More tv time and jail.

If you visit the sport threads you know that I am a huge USC Trojans fan. OJ you messed-up and you paid the price. There isn't anything I or anybody else can say to logically defend you. I will always remember you as a great Trojan. This is a sad day in Trojan land...

OJ - Guilty and no riot in LA or more American Cities. If you can not riot how are you going to get a free TV.

If there was one black juror on the trial,= now sir, here is your answers ok, sorry if you is hurt by the truth, and I am not a mean spirit person, but you need to know ok_==The jury that convicted Simpson consisted of three men and nine women, including one woman who identified herself as Hispanic, a court spokesman said. The jury contained no blacks, the race of both defendants.

Charles Location: Florida, charles you is so right about the jury make up. no blacks on their at all, so eventhought many out there thinks this is over, the only thing they did was made it so for Mr. simpson laywer to get a new trail. many of you people of haterd,it is hard to see throught a heart of hate.

Weird story...I actually met him in Las Vegas 2 years ago while playing golf (we were not playing together). He had no cash for the beer cart so I spotted him a $20 bill. After the round, he found me in the clubhouse and gave me a $20 and his 9.5 Cleveland Launcher. Seemed to be a nice guy, but he really needs to be in prison. Hmmm, I wonder who'll get his clubs?

Good. This murdering psycho really messed up the science of forensics in the crimnal justice system. Alot of murderers have gone free because of this monster.

Posted by: Blog Refuter Location: NC on Oct 4, 2008 at 06:52 PM
You would think that he would have tried to stay out of trouble since good old Johnny Cochran passed away.

Posted by: someone on Oct 4, 2008 at 05:35 PM
he wasn't punished because he's black as some want to believe but because he committed several crimes! skin has nothing to do with crime, white, black, whatever! a crime is a crime and race is nothing to excuse for it! you commit a crime, you do the time. that's how it works! doesn't matter your race, you shouldn't get special privileges if you break the law regardless of race or religion or background. the law is the law, simple as that. you do the crime, you take your punishment. that's how it works....

It's about time but I am sure he will be out and free before the year is out. Because once Jesse Jackson and Al Sharpton catches wind that a black celebrity man got arrested, NAACP will be called and a rally will begin!

there is nothing anymore racial about this jury than there was the jury which allowed him to get away with butchering his ex wife & her friend. he should have been in prison for the last 14 years. now the liar & murderer is seen as a thief and a kidnapper

Posted by: ??? Location: NC on Oct 4, 2008 at 02:44 PM
Las Vegas police better get ready for the riots. Oh thats right, this is Las Vegas, not Los Angeles. People here arent looking for just any BS reason to have a riot.

Posted by: Mary Location: NC on Oct 4, 2008 at 01:28 PM
To Charles: What difference does it make what the ethnic make-up of the jury was. When selecting potential jurors, both sides ask questions and have the right to select or dismiss any juror interviewed.I think he got what he deserved, there was enough proof to convict him. It is time he learns he is not above the law because he's "O.J.".

Posted by: MH Location: Eastern, N. C. on Oct 4, 2008 at 12:25 PM
Mr. Simpson, THEY GOT YOU !!!. I fully support the justice system in that in 1995, Mr. Simpson was acquittedd of a crime he didn't commit. Thereafter, the disbelievers (general conversationers, news networks/guest speakers (appalling)) would imply to a point that he was guilty. I tell you Mr. Simpson was acquitted. I am also a bit upset that when one is acquitted of a crime, a lesser court can convict you of being responsible for that same crime. That's not double jeapody, but the lower court has enforced upon the higher court "a slap in the face". "GET IT RIGHT". Getting back on track, Mr. Riccio went to/talked to the FBI/Police Department prior to the incident. That was a red light for them to investigate. What is the world coming to, when the people we pay to protect us can chose which incidents to investigate. They should be reprimanded as well. The whole incident could have been averted if they had cared enough. Greed/turncoats/deal makers, off of Mr. Simpson's reputation.

Looks like Nicole Simson, and Ronald Goldman finally got justice. What no rioting in LA today? I guess nobody cares about poor OJ anymore. Looks like you played your last Golf Game OJ. Maybe you can get a job in thr prison kitchen you are very good with a knife. Good Bye.

To Charles, Let me say OJ was acquited at his murder tril. The man was guilty of murder all of America knows that, as well as the eleven people that made millions defending him. Like they say money talks and the guilty walks. You know there will be a final judgement on OJ some day and God will not care if he is "BLACK OR WHITE"

Posted by: Anonymous on Oct 4, 2008 at 10:22 AM
Look at this way Charles. If this was false justice then he can sit in jail and think about what he did to Nicole and Ron for the rest of his life.

Posted by: George Location: Kinston on Oct 4, 2008 at 10:17 AM
He has laughed at the justice system for year, now he gets what he deserves. Just hate he can not get the death penalty for this crime.

Posted by: Don't hate Location: NC on Oct 4, 2008 at 08:15 AM
Give me a break Charles ! Don't play the race card. If there was one black juror on the trial, then it was fair. I'm sure there was at least one black juror. The jury must have all 12 jurors agree unanimously on the guilt of OJ. If it was about race, the one black juror could have upset the whole verdict, but that was not done. I am not racist, I have lots of black friends, and people like me who are white, get tired of hearing this race nonsense all the time ! We are all brothers and sisters and we are all the same color inside. Think about it. God Bless.

Posted by: Cactus Location: Strabane,NC on Oct 4, 2008 at 08:15 AM
We just can't get away from playing the "race card" can we.

Posted by: Charles Location: Florida on Oct 4, 2008 at 05:23 AM
my only question is what was the ethnic make-up of the jury in this trial? I'm going to bet there were no blacks allowed if that was the case shame on the Judge who presided over the trial..I know many people were mad at the idea of O.J.'s acquital in his prior case but falsely incarcerating is nothing more than False justice.

Posted by: good on Oct 4, 2008 at 02:42 AM
oj played golf and lived the high life while Nicole and Ron's family suffered as a murderer was free serving no time, and paying no fines for the civil suit. His children are grown, thank goodness...hopefully they can depend on Nicole's family for support.the bum deserves life in prison.
