Oregon Bus Driver Suing In Firing Over Confederate Flag

A school bus company has asked a federal judge to dismiss a lawsuit brought by an Oregon driver fired for refusing to take a Confederate battle flag off his pickup truck while parked on school property.

A lawyer for First Student Inc. argued Thursday that the flag was not political speech protected by the U.S. Constitution, but merely a private expression of Webber's "redneck" lifestyle.

The flag is emblazoned with the word "redneck."

The company says they fired Webber for insubordination after the Phoenix-Talent School District told them the flag violated a policy prohibiting symbols that express racism or white supremacy.

Webber's lawyer argued that even as an expression of lifestyle, the flag amounts to protected speech.

Magistrate Judge Mark Clarke didn't say when he would make a decision.

    Let's just make it simple. The Confederacy was a group of people who committed treason. They left the Union, then opened fire on a military instillation owned by the Union. They started the war, no matter how you want to look at it, those are the facts. All this was over slavery, the Confederacy didn't like that the north wouldn't enforce the fugitive slave act, and knew it was only a matter of time before slavery became outlawed. So yea, it was a states right issue, and that issue was with slavery. If you support the confederacy, you support treason against he United States of America. I'd be no different than if a group of radical extremist, like the tea-party for example, got tired of being treated like fringe lunatics, which they are, but whatever, and decided to start their own government and do this by blowing up the white house. It's treason, cut, dry, and simple.

    Your right to freedom of speech does not apply on private property. You are then a tresspasser. I think people just over react. Mostly looking an excuse for something or another. The confederate flag is not a symbol or racism or hate. It is simply the flag of a country that was invaded and occupied. The slavery issue was settled with the Missouri compromise. Tarriff's and the northern states refusal to count all southerns in a census to ensure they always had control of both houses of congress led to the war after Abe won the presidency. The slave issue was drug out because the north was loosing and support for the invasion was going away.

    Don't have a confederate flag nor a Obama bumper sticker on my truck.But I believe our forefathers fought a war to earn the right to do so and our military, past and present has put their life on the line to protect that right.Patriotism may sleep sometimes but it never dies!

    It is not appropriate to display the confederate flag unless at a museum. Otherwise it is just a symbol of defiance and racism. Good luck explaining that to most of the people around here.

    people need to get over the whole confederate flag issue... It's a part of history... I hate to tell people but in most cases people who fly or have the confederate flag are not wearing/displaying it because they are racists or white supremacists. Some do it because they are just proud to be a southerner... If the flag had embossed on it the term "Redneck" how is that a racial comment toward african americans? Obviously it wasn't meant for them so why make it about them. If it was on the bus I could see them saying something but I do not think it's wise nor fair to tell a man what he can or can not have on his personal vehicle! I hope he wins!

      I hope he does too! Redneck's are not stupid like everyone associates the term with. It was used to describe people who had sunburnt necks from working! What a concept so many people don't grasp... putting in a hard days work!

    Learn your history. "Old Glory" flew over slavery 90 years before the confederacy was born. The flag has nothing to do with slavery. Just an excuse. Its a matter of freedoms and we still deserve ours. Anybody that does not like it can go back where they came from.Wake up America, our freedoms are slipping away.

      He ruled that Obama had to be put on the ballot because the people who didn't say he was valid were racist idiots. They were arguing that you're parents both had to be American citizens for you to be an American citizen, which isn't just wrong, it's moronic. It would also have made Mitt Romney ineligible as well.

      Well, maybe it's because homosexuals, immigrants, and Muslims are all American citizens and productive members of society? Why should they not be entitled to equal treatment and services from the government?
