A federal judge ruled the website healthypirates.com must be taken down after East Carolina University sued over trademark infringement.
The ruling says Roy Hopkins Jr. of Greenville can not use the term "pirates," any skull and crossbones logo, any other logo, or the colors purple and gold, in a manner that is confusingly similar to ECU's logos and color scheme. Hopkins also must transfer the domain name registration "healthypirates.com" and pay the university's costs and attorneys' fees of more than $36,000. Hopkins has 30 days to comply.
Last April, the university sued Roy Hopkins, Jr. claiming trademark infringement, cyberpiracy and unfair competition.
Senior Associate University attorney Paul Zigas says "Healthy Pirates" has been used for at least 10 years by an ECU student-organization that promotes health and wellness.
WITN contacted Roy Hopkins Jr. and he says he has no comment at this time.
