Elderly Walmart Greeter Hit With Milk Jugs

Police say an elderly Walmart greeter was assaulted by a young man he thought may have been shoplifting.

New Bern police have charged 25-year-old Austin Stusalite with simple assault after the attack Monday night.

83-year-old John McClean says he saw a young man leaving the store with two one-gallon milk jugs that weren't in a bag. McClean says he asked for a receipt, but the man kept walking away. McClean says he reached for the customer who then turned and hit him with the milk.

Another customer was able to stop and hold the suspect until police arrived.

Officers did confirm that Stusalite did pay for the milk.

    TO ROB, ya need to read NC G.S. 15A-404. a private citizen can not arrest but can detain until the ploce arrive for certain illegal violations in NC. a wal mart greeter is considered a private citizen. they can detain witout moving them other than to an office for police to arrive for the following OR SUSPECT OR PROBABLE CAUSE TO BELEIVE AN OFFENSE OF THE FOLLOWING HAS BEEN COMMITTED FELONY,BREACH OF PEACE,CRIME FOR INJURY TO OTHERS,THEFT OR SUSPECTED THEFT or DESTRUCTION OF PROPERTY. hold for police without movement other than an office until police arrive. so there is no citizens arrest , there is a citizens detainment allowed by law under nc gs 15a-404. hope this helps out for anyone that encounters this situation.     Read the story the last line confirms that officers say he DID pay for the milk.

    Anonymous, you set one down, reach in your pocket, and show the man your receipt. Hitting the guy and running for dear life implies he didn't have one. Does it actually say anywhere the guy paid for the milk? If he did, a lot does not add up. I'm thinking he stole it. Why else clobber an old man over the head and run?

    This 25 year old should be "Milk Boarded". I guess this is why we don't have a Milkman anymore. I miss the good ol' days.

    Hey Actual Witness...Get the heck off of your cell phone and pay attention!!!!! The Greeter has a job..and you do too...Get off the phone, show him your receipt and get out of the store!!!! Then you can get on your &*^^$%$# phone!!!! I'm sure that was an important call....HEHEHEHEHe

    did this guy restrain the milk jug dude or reach for him? the story said he reached for him. and if a walmart greeter asks for a receipt you better give them your receipt. thats their job. if you had a busy store youd want to do inventory control as well.

    In North Carolina you cannot physical restrain anyone (unless you are a sworn officer)there is no citizens arrest. As wrong as it seems all the greeter can legally do is follow the suspect until Police arrive. He may end up with all the milk he every needs at no charge and the greeter may be unemployed.
