Banned From Church, NC Sex Offender Goes To Court

A North Carolina man is challenging a state law aimed at keeping people like him away from children. The case pits the right to worship against laws that restrict where convicted sex offenders can go.

Police arrested James Nichols in March after he attended a Sunday service at a church in Moncure that offers day care.

Nichols was twice convicted of indecent liberties with a teen girl and again in 2003 for attempted second-degree rape.

Many of the three dozen states that establish zones where sex offenders can't live or visit don't provide exemptions for churches.

Advocates agree some convicted sex offenders should never be allowed around children. But they say barring all offenders denies them support needed to become productive citizens.

A similar lawsuit is pending in federal court in Georgia.

    The perverts are the people with the closed minds. Not all people on the 'so called' sex offender registry are not predators nor child molesters. The man needs to be in church to rehab himself.......

    Since the guy wants to go to Churh maybe he should be ordered to do CHURCH and made to sit on the front row where everyone can keep an eye on him.Let some of the men usher him in and usher him out every time the doors open.The guy is a second time offender.For GOD"S sake and yes I said it. "GOD" a word that to many people don't want to hear today.This man's screwed up ideolgy is just about where a lot of American's . The right to worship is not the issue,it's the order to stay away from Children,but I say let him go to church.And let the congregation watch and keep an eye on him. Apparently he can't control himself.If he were ordered to attend CHURCH he would be filing a junction against a the Government for forced Religion.The courts made a decision,let it stand.This is no less than ego arrogance at it's best.

    he can worship at home . Or standing in the middle of the busy road. If any of you feel strongly about this story as you must for reading it please compare and contrast it with this: people who did the same type crimes prior to 1996 when the registry came about have no such restrictions. In factr if you r a NC taxpayer you should be outraged that a convicted admitted felon little girl molesting doctor, thats right doctor, works for the state of NC and makes 200,000 of YOUR dollars. Everytime I mention his name the blog police won't allow my comment which is crazy since the story broke on this channel back in July 07. You can do a search " cherry doc on leave" on this website to see the story. Please write legislators @ NC.GOV and tell them we dont wont child molesters wotking in state government and demand tougher state laws against molesters. As for the story here the guy can worship at home he should not be near any kids ever, he should get a public hanging

    He should have been in a church when he was touching babies. Now he is so religious! He lost his rights when he couldn't control his perverted mind and body. Let him pray at home with Jimmy Swagger. The Good Lord will sort those freaks out later... keep him away from our children now!

    I don't know about this particular man(he seems to have too many convictions) but I have seen how some laws are too black and white; life is full of grey areas. I have seen how not everyone with this title is not a predator. I have seen a case of this that really helped me not become so closed minded.
