A Fort Bragg soldier whose lawyer says he shot at firefighters and police outside his Fayetteville apartment because he thought he was being attacked by Afghan insurgents wants to be prosecuted by the Army instead of in civilian court.
The Fayetteville Observer reports that Staff Sgt. Joshua Eisenhauer filed a lawsuit in federal court asking to be tried by a military court.
Eisenhauer is being held at a state prison, and a psychiatrist wrote in legal papers that he cannot get proper care for his mental illness there.
Letters from three other doctors say Eisenhauer was likely suffering from post-traumatic stress disorder when he started shooting at firefighters battling a small blaze at his apartment in January.
Prosecutors want to keep the case in state court.
