State: Votes For District 5 Senate Seat Don't Count

If you voted in the North Carolina district 5 senate seat, your vote didn't count.

The race between Tony Moore of Winterville and Don Davis of Snow Hill still looked legitimate on the ballot, but, the state board of elections had ruled last week Moore could not run because he hasn't lived in the district long enough to run for district 5. Moore appealed that decision. Because of that, the state decided none of the votes for either candidate could be released.

We tried to reach both candidates. Tony Moore returned our calls and says if the court of appeals reverses the states' decision he will ask for a whole new election, rather than take the votes from this primary election.
