A former state senator will be allowed to remain on the ballot in several Eastern Carolina counties.
Tony Moore's residency in State Senate District 5 was being challenged by the president of the Pitt County chapter of the NAACP.
Calvin Henderson claimed Moore hasn't lived at his Church Street home in Winterville long enough to claim residency for the senate seat. The state constitution says a candidate has to reside in the district a year immediately before the election.
An election panel today ruled in Moore's favor. An attorney for Henderson say they will appeal to the State Board of Elections.
District 5 covers portions of Pitt, Wayne, and Lenoir counties and all of Greene County. Former Senator Don Davis is running against Moore in the Democratic primary.
