UPDATE: DA: Marine Corps Will Handle Marines Beating Death Case

Jacksonville District Attorney Ernie Lee says the case of two marines involved in the beating death of a man will be turned over to the Marine Corps.

Camp Lejeune marines Brandon Cotter and Erik Ketterman remain behind bars. The DA says the marine corps took over jurisdiction in the death of Jimmie Senn and the state has agreed to dismiss the case.

If this case was tried by the state, both marines would possibly be convicted of involuntary manslaughter with a sentence of less than two years or probation.

Lee says it is likely the two marines will face a court martial.

The district attorney says he will await autopsy results before deciding whether charges will be upgraded against two Camp Lejeune Marines.

Jimmie Senn of Pollocksville died this past weekend in a Wilmington hospital, a week after he was critically beaten at a Jacksonville bar.

Two Camp Lejeune Marines, Brandon Cotter and Erik Ketterman, were charged in connection with the assault.

District Attorney Ernie Lee says he will wait for the autopsy to be performed on Senn before they proceed with any additional charges. That could be later this week or next week.

A man critically injured in a bar fight a week ago in Jacksonville has died in a Wilmington hospital. Two Camp Lejeune Marines were charged with that attack.

A spokesman for New Hanover Regional Medical Center tells WITN News that Jimmie Senn of Pollocksville died this weekend.

Senn and his wife were injured last Saturday at Ducks Bar and Grille on Gum Branch Road. Two Camp Lejeune Marines, Brandon Cotter and Erik Ketterman, were charged in connection with the assault.

The 22-year-old Cotter was charged with assault inflicting serious injury and assault on a female. Ketterman, who is also 22, was charged with accessory after the fact.

The District Attorney's office tells WITN that because Senn died of his injuries, the assault charge will escalate to a homicide charge. Ernie Lee says it is likely the charge with be second degree murder or involuntary manslaughter. We expect to know more on Tuesday.

A man remains hospitalized in serious condition after police say two marines beat him up.

Two Camp Lejeune marines, Brandon Cotter and Erik Ketterman, stood before a judge Monday accused of beating a Pollockville man this weekend at Ducks Bar and Grille on Gum Branch Road in Jacksonville. Police say the man's wife was also injured in the fight. That's why Cotter faces a $200,000 bond. His charges include assault on a female.

Ketterman's bond is set at $150,000. Both marines are due back in court January 30th.

Two Camp Lejeune marines are facing charges after a bar fight leads to one man being seriously injured.

Jacksonville police were called to Duck’s Bar and Grill on Gum Branch Road around 2:30 a.m. Saturday to a report of an assault.

Officers found 34-year-old Jimmie Senn of Pollocksville unconscious at the scene. Senn was transported to the hospital where he is in critical condition.

Police say the victim’s wife, 41-year-old Billie Senn of Pollocksville, was also struck during an altercation.

After an investigation 22-year-old Brandon Cotter and 22-year-old Erik Ketterman were arrested.

Cotter is charged with assault inflicting serious injury and assault on a female. He was given a $200,000 dollar bond. Ketterman is charged with accessory after the fact and was given a $150,000 dollar bond.

Police continue to investigate.

    I think you should all stop, look and listen to yourselves. These two guys were everyday citizens of wherever they grew up BEFORE they joined the Marines. If they were in the Air Force would you still call them animals. The Marines didn't make them this way. They probably had these tendencies prior to joining the military and the lack of proper "self-discipline" has caused them to act without thinking. It's tragic to all parties involved and I hope that all of the facts are weighed and that justice is done. Those two guys have to live with the death of another person that could have been prevented and the family is without a loved one. There is no happy ending to this fiasco.

    all it takes is 1 punch to knock someone over and bump their head...they didnt beat him savagely .... its basically the plot of con air.... brandon didnt mean to kill him... its a terrible tragedy on both sides.

    My son has died. Nothing will bring him back. The good news is his baby brother and wife are expecting a child. Hopefully a boy. He loved his 3 little girls more than life itself. He loved being a Marine, he was hoping to bring his 3 girls to my house for spring break and summer so he could spend time with them at the ocean. Now this will not happen. I don't know what happened, but I'm sure all this he said she said stuff really won't make a difference in the end. Please just tell the person close to u that u love them and hold them close. I had talked with Jimmie about 7 times on Friday, and several times during the week...all he talked about was his girls and having a new niece or nephew....what happened happened, now to pray for the families involved. Always Loyal!

    So many different stories have been told. I hope they get the correct one. And there was another man with them, where is he, he told them about the bar. He was at the hospital on Sat. the 7th, but did not show up any other time. and Compassion, sorry BJ showed no compassion towards his 3 girls at the funeral, or to his family at the hopital or funeral. Yep she gets all the $. The girls get nothing. This is not what Jimmie had planned. Alot of things not adding up, hope NCIS looks at all angles...Story told to family, said the men came from no where as they were getting into the truck to leave. Jimmie was hit, she was hit, got up and ran to get tag number....????? She was delayed in getting to the hospital... cause/???? she went to get Jimmie's phone....?????Where is the missing guy that was with them....????? What did he see.....?????

    The real tragedy in all this is his ONLY biological children, 3 beautiful girls are left without a father. Now his wife of barely 6 months gets 500k and his 3 BIOLOGICAL children get squat! Now they have no father and their mother is left without any financial support to raise her children. They were married a very long tome and recently divorced and now she will have to struggle even more because he and his new wife left NO financial provisions for the only biological heirs he has. Sorry but her 5 kids from god knows where and from whom will have the financial support that his OWN children don't. I dont know which is more disgusting her saying she felt compassion for the man that slapped her and killed her husband or that his children are left fatherless and with NO support.

        No they were told by jag they get nothing more than an id card and medical care that's it. If there's info you know that I can pass on I'm sure their mom would appreciate it. She's really just so overwhelmed by all this. His death was a tremendous loss for her girls

          So many stories, some say BJ instigated it. Jimmie is not a fighter, he walks away from bar room stuff. If he was protecting her, then why? what had she done that she needed protecting...and why were we told the men came from out of nowhere? Character witness's on all of their behalf will be called upon.... and some will not be so good. Hope the NCIS gets all the facts!

    Everyone has the right to his or her belief. Let’s look at this from a wide spectrum. In both parties these two Marines killed a man and assaulted a woman. Anyone that knows a thing or two about criminal justice would know this is a felony. Involuntary manslaughter if tried by the state. On the Marine Corps side of the house well the "UCMJ" Uniform Code of Military Justice is not a get out of jail card. They will go to a General Court Martial where they will indeed be found guilty. In the Military this will be a Commission of a Serious Offense. Then they both will face a "BCD" Bad Conduct Discharge. As they should either way! These actions are not the one of Marine’s. These two men have dishonored the Corps by their actions. Marines are known for their history and honor to serve this country. The serious question at hand here is this, why is this case being turned over to the Marine Corps? Honestly I don’t believe they will get any less treatment. It will be way worse. If you have ever worn a Service Uniform I think you can understand the Regulations and the seriousness of those charges that are against them at a General Court Martial. This is something that has brought discredit upon the Armed Forces, which will not be taken lightly.

        It is fact that they are two killers who just got a get out of jail free pass... I am ashamed to know they are in our military and in our lovely Eastern NC area. Send them directly to Leavenworth.

          The real story is that someone assaulted this man and it took his life. I am not the least bit ashamed nor do i need anything from you regarding inner peace over calling a spade a spade.
