Obama administration attorneys are asking a federal appeals court to rule against families who blame contaminated tap water at the Camp Lejeune Marine Corps base for birth defects, childhood cancers and other illnesses.
A Justice Department attorney citing a U.S. Supreme Court ruling on Monday filed a request to the 11th U.S. Circuit Court of Appeals in Atlanta the same day. The Supreme Court ruled that a group of North Carolina homeowners cannot sue because state law strictly bars any lawsuit brought more than 10 years after the contamination occurred.
Government lawyers say that high court ruling should end the Camp Lejeune lawsuit.
President Obama approved a law in 2012 providing health benefits to Marines and family members exposed to the water from 1957 to 1987.
