A judge has denied a request by a Martin County man accused of killing his wife back in 2009 to have his case heard in a different county.
Albert Gurkin Senior, 63-years-old, remains in jail charged with strangling his wife, Jewel, to death, back on May 13, 2009 in Martin County.
Gurkin reported his wife missing. She was found three days later-- buried two miles away from their home.
In court Gurkin's attorney asked for a change of venue or a jury pool from a different county, so Gurkin can get a fair trial. The judge denied the request.
A trial date has not been set, although it's expected to take place in the spring.
