FIRST ON WITN: D.A. Says Home Invasion Death Of Naked Man Justified

The Onslow County district attorney says an April 8th shooting death of a naked man after a home invasion was justified.

Ernie Lee says David Darling unlawfully entered a home on Fieldcrest Drive and threatened those inside. Darling was shot and killed by the Marine who lived at the house. Darling lived next door.

Lee says the investigation shows at 9:12 p.m. deputies were dispatched about someone trying to get into the home. Nine minutes later those inside the home were waving down deputies.

Lee says Darling was found lying on his back in the living room. He later died at the hospital.

The D.A. says the 24-year-old man in the home says he heard Darling yelling on the street. "I am on a bad trip, and I will not kill myself for her," Darling was heard saying.

The Marine says Darling was naked, running up and down the road and then sat at his front door. His wife opened the door, finding Darling talking about a cigarette. She told him to get off the property.

The people at the house said Darling yelled to let him in and began banging on the front door. The Marine told Darling to leave, warning him he had a gun.

Darling, according to those inside, jumped head first through a screened window, and the Marine shot him three times.

The D.A. says there were two small children in the home at the time and says the Castle Doctrine applies in this case. Lee says the Marine honestly believed he needed to defend his family.

We expect to find out Friday morning whether charges will be filed against a man for fatally shooting an intruder in his home.

Onslow County deputies said 22-year-old David Darling was shot and killed on Fieldcrest Drive near Jacksonville on April 8th. Darling was attempting to enter a neighbor's home through a broken window around 9 p.m.. The man inside the home shot Darling.

The district attorney is holding a press conference on the shooting at 9 a.m. Friday.
