Prosecutors in Onslow County have dropped all charges against a mother and son for accused in the murder of a man in 2009.
Victoria Hernandez and her son Ricardo Hernandez were charged with first-degree murder and conspiracy for the death of 33-year-old Ardelio Mayo's death.
District Attorney Ernie Lee said today there was insufficient evidence to prosecute the two. Specifically, Lee says there is doubt whether Mayo was actually murdered or not.
While the State Medical Examiner's Office initially ruled the death a homicide, a defense expert was ready to testify that there was a high probability that Mayo's death was a suicide.
The district attorney says the mother and son said Mayo "had gone into a frenzy and began stabbing himself." The two maintained their roommate had committed suicide and they were injured as they tried to stop him from harming or killing himself.
Their attorney said after spending 618 days in jail, both the mother and son have been set free.
