No Charges In Deadly Officer Involved Shooting

The district attorney says he will not file charges against a reserve deputy sheriff in a shooting that killed a Havelock firefighter in February.

Onslow County D.A. Ernie Lee made the announcement this morning after receiving results of an SBI investigation into the shooting. Lee says the shooting was justified, that Austin Zundel had been drinking and had a fight with his wife,

Lee says the man was shot five times by Adam Stock, a reserve officer with the Onslow County Sheriff Department and contract instructor at the Marine Corps Law Enforcement Academy. The D.A. says Zundel had a blood alcohol content of .14.

The SBI investigation shows that Stock told Zunel several times to put the gun down, but Zundel came towards him. Lee says Zundel hit Stock in the face with his gun and pointed a loaded gun at him. The D.A. says the shooting was justified to protect the life of Stock and others.

Zundel was killed after there were reports that a man was walking around a Swansboro neighborhood firing a gun. Stock, who was off duty at the time, lives in that same neighborhood. Police said the two men got into a fight and Stock ended up shooting Zundel.

The district attorney says Zundel's wife was one of those who had called 911 about her husband shooting a gun in the air. Lee says the man died of a gun shot wound to the abdomen.
