Federal Court Dismisses Two Lawsuits Over Obama's Healthcare

A federal appeals court in Virginia has dismissed two lawsuits that had claimed President Barack Obama's health care overhaul was unconstitutional.

The unanimous decision was issued Thursday by a three-judge panel of the 4th U.S. Circuit Court of Appeals. It is the second appellate court ruling affirming the government's right to require individuals to buy health insurance or pay a penalty. A federal appeals court in Cincinnati also upheld the law, but an appeals court in Atlanta struck down the insurance mandate.

Two of the judges on the Virginia panel were appointed by Obama, the other by Bill Clinton. They rejected claims by the state's Republican attorney general and Liberty University that the insurance mandate is unconstitutional.

More than 30 lawsuits have been filed over the law.

The problem I have with this law is it didn't curtail the world-record profit margin that our pharmaceutical industry continues to reap while a multitude of drugs seem to be causing chronic problems.

Let's check on a nation with a long history of Obamacare-like government controlled medicine. In Britain, family doctors have been ORDERED to RATION the number of patients they send for LIFE-SAVING cancer scans to save money. They are being told to SLASH the number they REFER to hospital for tests including ultrasounds, MRIs and CT scans commonly used to spot tumours. Last night experts warned the cost-saving measures increased the risk of patients being diagnosed too late and dying unnecessarily.

That's one way to interpret what the UK did. Not the correct interpretation, of course.

So, just how do you interpret it? Let us all know your version as I can find info verifying the other poster, however, not yours.

The UK's system is simply following protocols long established by U.S. private insurance companies, which invented the practice of rationing diagnostics and treatment. Do you think it's ok for private insurance to do this?

Using driver's license and house insurance as an argument as to why we must be forced to buy into obamacare makes no sense. The government does not require anyone to purchase a vehicle or a house.

Well then, you pay for it. If Obama went to law school, then he knows himself its unconstitutional. He should be in trial for not upholding it since he took an oath to uphold it. However, socialists don't believe in our constitution or our republic....

I'm curious as to what you feel is unconstitutional about the individual mandate.

The government cannot mandate a fine for a service like insurance. A state can mandate you have insurance on your car if you drive it, however, they cannot mandate you have a car.

Waste some more money on this why don't you? How many lawsuits is this anyway? HOW ABOUT A JOBS BILL instead? What happened to the jobs the Republicans were supposed to create? We extended the tax cuts for the rich (job creators) that was supposed to do the trick but I guess that is just MORE wasted money.

We are still waiting on all the jobs Obamas stimulus was supposed to create. How much money did Obama waste on the lawsuit he filed against Arizona for enforcing a federal law?

I do not understand. if everyone has to purchase health insurance there has to be a way to make it more afforadable for everyone, including all of us that are paying for those who do not have it. We are forced by law to have auto insurance, insurance on our homes if not paid for. We have to insure material things but not ourselves. I do not get it. MAKE IT AFFORDABLE, SO EVERYONE CAN BENIFIT FROM IT. If they can not get it to become law, give a credit to those of us who do carry it. Don't penilize the ones who do not, as some of them are not by choice. They just can not afford it.

it is not law that you have to insure your home.. it is a requirement of most mortgages but if you don't have a mortgage you do not have to insure your home. I carry a a health insurance plan but believe that if wanted to private pay I should have that right.

Get over it.... Healthcare should be 100% free, especially in THIS country. Healthcare should be for the betterment of our citizens not for profit. Bash "Obamacare" all you want but, while you are at it why don't you bash pharmaceutical lobbyist to?

We pay for healthcare already with Tax dollars. I'm sure those that decided to bash me up here were assuming that I was some kind of drug addict baby factory. I'm also sure they complain and shout about welfare recipients or illegal immigrants receiving free health services. Which brings me to my point. We have a free system now that DOESN'T benefit the tax payers. So who is crazy? I just want to benefit to. We are the only Industrialized Super Power in the world that doesn't have some form of free medical care for it's citizens. That's all I'm saying.

I love the "why don't you bash (insert scapegoat) instead" tactic. Supporting the general welfare means taking care of your neighbor; NOT giving random strangers your money. It's government supported THEFT.

Let me quess you are against drug testing for state and federal aid? OH YEA it is unconstitutional for you to have to take a drug test for free money and I have to take one to work for my money. GET A JOB BUMM!!

if it was free then no one would pay for it which would be sad since then the doctors nurses, cnas, paramedics, etc. wouldn't get paid and they do deserve to earn a living... Obamacare is about thinking that somehow the government is better at spending my money than I am and I think the deficit and budget issues speak for themselves on that account.
