4 NC Tobacco Firms Sue FDA Over New Graphic Warnings

COLUMBIA, S.C. (AP) -- Four of the five largest U.S. tobacco companies are suing the federal government over new graphic cigarette labels that include the sewn-up corpse of a smoker and a picture of diseased lungs.

R.J. Reynolds Tobacco Co., Lorillard Tobacco Co., Commonwealth Brands Inc., Liggett Group LLC and Santa Fe Natural Tobacco Company Inc., said they filed their suit against the Food and Drug Administration late Tuesday. All the companies are based in North Carolina except Sante Fe Natural Tobacco Company.

The companies say the warning labels violate their free speech rights by requiring them to carry a government-sponsored emotionally charged appeal to not use their legal products. They want the labels stopped.

FDA officials said they could not comment because of pending litigation. The agency said in June when it introduced the labels that they are powerful and frank warnings about the dangers of smoking.

    I agree with OSOC for once.Taking toys out of fast food meals and placing these photographs on packs of smokes WILL NEVER TAKE THE PLACE OF PERSONAL RESPONSIBILITY!!!!!!!! NO ,Shirl, we will not get with the program.The sad fact is you were born to die.As a matter of fact the instant you were conceived the countdown began,spend your time as you will.. SCREW THE BANDWAGON !!!!!!!!!!

    Get with the program !! I am from Canada and they have pictures on the packs of smokes there for YEARS! In fact 3/4 of the pack has a photo on it. About time the US gets on the band wagon. If you want to smoke and don't like the picture DON'T LOOK... and the companies should be ashamed of themselves, after all they are the ones killing people !

      I will be so glad when they put those malinomia warnings on tanning beds, obesse people on Big Mac burgers and dead children on bottles of wine, liquor and beer. You tell them Shirl. I only hope they put those on cell phones, skate boards, skiis, jet skiis, snow mobiles, cars, bicycles, mopeds, dogs, lakes, ponds, rivers, oceans, houses, boats, cold climates heaters, warm climate AC, airplanes, electricians, truck drivers, fisherman, construction workers, soldiers, fireman and policeman. I hope I got all the people that take risk. All should be ashamed of themselves. I have had to go to funerals for many...they all look deceased to me...just differnent causes. You with the label advertisement lobby or the Obama liberterds?

      Shirl, I forgot to add some others, I am so sorry; motorcycle riders and drivers, kids near swimming pools, people that have pit bulls, handgliders, swimmers, water drinkers, food eaters of any kind, people that breathe, hunters, walkers, runners, cat owners, yard workers, roof workers, Wall street dealers, shoppers, sellers, national park visitors, park workers, politicians, TV reporters, book writers, office workers and office managers, school student...did I cover them all? I am with ou Shirl...violating the second amendment is so important to the socialist agenda we should just do it. Besides...think of all the money you will get from advertisement? Thanks...but most of us will die from something without the socialist agenda you have. Most of us here in America came here for freedom and not government control.     Pitt county is the most highly subsidized tobacco growing county by the federal government, in the most highly subsidized state. As much as I am passionately against subsidizing these death-sticks, I believe it is a violation of free speech to label them. They should be either legal or illegal. Don't play both sides of the game.

    Should Post A Picture of a casket Or Hearse on all Alcohol Based products sold @ ABC stores. I Do Not Smoke Nor Drink & have no interest in this one way or the other. I Do Think the Goverment Is Going about this in the wrong way.But don't they have a way of Messing Up Everything They Get Involved with? They Cannot even Manage their own problems. It Is A Proven Fact Cigs may kill you,I know alcohol sold at ABC Stores when consumed too much causes Wrecks on Highways killing people.Also Drinking too much makes some folks really crazy mean & They go home & beat up on their families. "Tax The Heck out Of Cigarettes & Alcohol"(Yes Beer & Wine Too).Forget The Scary Warning Labels.People don't care Or Scare that easy. If The Taxes Are High Enough,People will cut down on Smoking & Drinking. WAnt To Really Regulate Cigs & Alcohol(Beer & Wine Included). Put The Cigs In The Pharamcy By Percription Only @ Super High Prices & Put The Beer & Wine In ABC Stores where it belongs & Yes "Tax The Living Heck out of it".. Don't have any interest.Just Saying.

    I agree with some of the other comments. They should put warning pictures on lots of things.... pictures of babies and STDs on bottles of personal lubricant, pictures of morbidly obese people on soda cans and candy bar wrappers, pictures of obviously ugly women altered to be seemingly acceptable on beer cans, pictures of broken legs on banana peels..... There can be no end to it. I mean, obviously people can't think for themselves.......

      I too agree that they should be putting warning pictures on a lot of things, like politicians, lawyers,tree and bunny huggers, NPS, PETA, ACLU, U S Justice system, just to name a few.

    I really don't care if someone I don't know chooses to smoke, but let's not delude ourselves into thinking that society doesn't pay a price when millions of people, many of them uninsured, end up getting lung or throat cancer, emphysema, or some other chronic disease. These big tobacco companies are getting rich selling a product that is raising the cost of health care for all of us. They fought the original warnings, also. They held off any legislation for at least 30 years from the time they knew their product was deadly. They will do anything they can to make money. They only care about their bottom line. Contrary to recent Supreme Court rulings, I don't agree that corporations should get constitutional protection. Corporations are made up of people, but the corporation itself is not a person... in my opinion.

    When your children enter a convenient store, you people want them to see dead corpses and other graphic pictures everywhere? You are all sick. Only reason you agree is the liberal media tells you to agree. Why stop at cigarettes? A corpse painted on the side of everybody's car should really help prevent wrecks? When the military advertises on TV and only shows corpses with there head, arms, legs and other body parts blown off should be a real help. Do you realize we paid some government employee to come up with this garbage? If cigarettes are that bad, do away with them even if we have to double our taxes to make up for the lost taxes.

      The cigarettes are behind the counter, in a rack. Even if you COULD see the sides of the package when they are in the rack (which you can't), at the distance they are from the counter (up high or on the back wall) the children wouldn't be able to see the offending graphics...On the other issue about the military...I agree! And I think everyone should see the Highway Patrol films that show the aftermath of bad car accidents. That might slow some people down, get them off their cell phones and make them pay attention when they are behind the wheel.

    They should put a picture of a dead smokers lung on the package. That would be more accurate and concise.

    I have no problem with these warnings. If it saves one life, it is worth it. Now, they need to add some graphic auto crash pictures to beer and whiskey bottles.
