A lawsuit has been dismissed that was brought by the father of the man who was killed in a shootout that also claimed the life of a Martin County deputy.
Last December Jerry Pace, Sr. filed a federal lawsuit against the former Williamston police chief, Sheriff Dan Gibbs and others for the death of his son, Jerry Pace, Jr.
The younger Pace was killed on December 8, 2009 along with Deputy Charlie Brown during a shootout on a Williamston street. The wrongful death lawsuit claimed other officers shot Brown and that Pace's son didn't get proper medical treatment and ended up dying.
A news release from the Martin County Sheriff's Office says the lawsuit was voluntarily dismissed with prejudice, meaning it cannot be filed again. The release says no settlement was made and that the dismissal relieves the sheriff, former police chief and other officers of any liability.
