Lawyers for the former prosecutor in the
Duke lacrosse sexual assault case will argue that the ethics
charges that could lead to his disbarment should be dismissed.
The North Carolina State Bar has scheduled a hearing for April
13th to consider a motion to dismiss the ethics case against Durham
County District Attorney Mike Nifong. He initially led the
investigation into allegations a woman hired as a stripper was
raped at a lacrosse team party in March 2006.
Nifong turned the case over to state prosecutors in January
after the bar charged him with violating several rules of
professional conduct, including withholding evidence from lawyers
defending the three players charged in the case. He's also accused
of lying to the court and to bar investigators, and making
misleading and inflammatory comments about the players.
