Judge Reinstates Wrongful Death Lawsuit For Iraq Contractors

A judge has returned to a state court a wrongful death lawsuit filed by the survivors of four contractors killed and mutilated in Iraq.

Blackwater Security Consulting argued that the case belonged in federal court. But after the Fourth U-S Circuit Court of Appeals and U-S Supreme Court denied their requests, Wake County Superior Court Judge Don Stephens ruled the case should go forward in Wake County.

The lawsuit was filed in January 2005. Attorneys representing the families of the four dead contractors argued that the workers found themselves in volatile Fallujah without proper equipment and personnel to defend themselves or the supply convoy they were guarding.

With cameras capturing the scene for the world to see, the mob burned and mutilated the guards, stringing two of the charred bodies from a bridge.
