A Jacksonville man is behind bars, accused of raping a 4-year-old child.

Sheriff Ed Brown tells WITN News that Juan Tyler faces several charges.

Tyler who lives on Cedar Creek Drive in Jacksonville was arrested Wednesday for 9 counts of 1st Degree Rape, 9 counts of 1st Degree Sex Offense with a child, 9 counts of Indecent Liberties with a child and 12 counts of sexual battery. The 4 year old's mother went to the Onslow County Sheriff's Office on July 29th to report Tyler. The Sheriff's Department says Tyler was put in jail without the benefit of bond.

I have known Juan for almost 20 years now and he has never ever given me the idea he would ever do this. You that are saying is guilty how do u know where u there did u see have u been around a child that has been abused? Do u know the signs of an abused child .. Child has been examined by a doctor and they confirmed she has been touched in ways she should not have been. as a friend of the family I can say this child is very intelligent and is not the kind of child who would make this up. of course he is denying it, what sex offender just outright admits to it? and to answer a question from another comment it was not detected b/c the child did not want to get in trouble and did not understand what was going on. The mother reported it as soon as she became aware.

IF this man is innocent, then it will be proven... maybe. Not all cases of sexual abuse on a child are proven. In fact, most times, it goes without even being investigated thoroughly. Most of the time, all it takes is the child to be examined by a medical doctor and then examined and interviewed by a child therapist and the truth will come out. It happens everyday.

for one second he was guilty....My brother loves his children, and the child in question,was raised by him...My brother is not a rapist.he is not a pedophile!!I was on the phone with him on many occasions when he was worried about his wife,her mental state, and his kids.He was trying to get custody of his children.his wife knew that with her background of mental unstability, that she would have a hard time getting the kids.. what proof was there in the duke lacrosse case? none, absolutely none, but that did not stop the powers that be from pressing on....i realize that the facts of these cases are different, but the premise is still basically the same...an innocent person(s) was accused of a crime,his name dragged through the mud,his future ruined, and a cloud of suspicion forever hung over his head...The atlanta bombings....another example of the innocent wrongly accused..When i was 12 years old, i was molested in jacksonville by a very disturbed,vile man...what he did to me is still with me..the damage he inflicted on me cannot be quantified....I know from experience what it feels like to have your childhood ripped away from you...i know what it feels like to have to live with those memories...My brother watched me go through this, so all of you out there that think that just because he is my brother, i am defending him..you are sooooo wrong....

The mother is not making this up. THe child has been examined and social workers have interviewed her. Child knows way more about sexual experience than she should. She came forward with this without being asked. True everyone is innocent until proven guilty but if Mr. Tyler is innocent why won't he take a polygraph test and why was he trying to leave town. And hiding out in his home. If he was innocent he would be wanting to take a polygraph to help clear himself. I know these people and I know some others of you do too but please don't post names or other info that could lead the media to the child. That would just put her through more than she has already been through. Say what yoyu want about the mother but if you really know her you know she is a good mother would know she is only tryin to protect her children. Mr. Tyler if you are innocent as you say then take a polygraph test, that is if you are stil in town. Hope the detectives are keepin a close eyes on you.

"Assuming and Naive"? Men of the law know to leave their personal opinions out of the picture. I'm sorry Anonymous blaming it on the wrath of an angry woman isn't very tactful. Evidence is evidence and that's what the judicial system is based off of. Anonymous you sound like you are the accused.....make sure when you throw the mother's dirty laundry out there you include all of your deceitful and dishonest acts as well. I think finally now that she has become independent and strong, you call her mentally unstable? I pray for you my friend, you have never been found guilty yet, people are voicing their opinion based off of the acts of the criminal justice system, there is nothing wrong with that. Freedom of speech, you have judged yourself. The troubling part is if he is found guilty, he will have more luxuries in life than what he has now. It's unfortunate but it's true.

Please don't make this a gender issue. I'm sure there are plenty of women out there that have dealt with a cheating, lying, lazy alcoholic. Not every man that has a child is a "father". Daran and annonymous are right, four year olds don't make up these types accusations. I have seen a similar situation and know that these men of the law wouldn't just "make up" 39 counts of rape, sexual battery and indecent liberties of a child. Substantial evidence my friend, I'm sorry he doesn't have a leg to stand on. Mr. Tyler we understand you trying to defend yourself but why not discuss these things with your lawyer instead of trying to convince the public of your innocence. I am pretty sure this mother is protecting her child from a vicious and sick man. There is nothing wrong with that, when it comes to sex offenders, NC Law does a good job of keeping these mentally unstable criminals away from our youth. You never know when someone has it in them. I pray for this child and her family.

How many of you have been through a bitter custody battle? how many men have been arrested because a woman FALSELY ACCUSED YOU OF SOMETHING YOU DID NOT DO... in life, in the eyes of the law, and the court system,women are given preferential treatment...why? some of you out there will say i am chauvanistic,but i assure you i am not...i have experienced the wrath of an angry woman,who was helped by an assuming and naive police officer...Please try to hold off on judging this man until he has been given what the constitution guarantees him....a fair trial..in this country, we all believe that you are innocent until proven guilty..that is sofar from the truth....you are guilty until proven innocent

I agree with what the last person said, 4 yr olds don't just make that stuff up. Even if she was told by her mother to say something, law enforcement officials take that into consideration when questioning the little girl. She must have been able to describe (in detail) what went on. From what I know, this man isn't a saint and the mother has had to deal with a lot. She is a strong woman and I wish the best for her family as well as his.

This whole thing is just crazy. I too know all parties involved. I agree you are innocent untill proven guilty. I hate to hear that this happened and I never thought he could do something like that but you have to admit 4 year olds dont just make these things up! And I think it would be pretty hard to make a 4 year old lie and say this took place! It's going to be an ugly day in court and I'm sure everyones dirty laundry will come out! With what this little girl is saying it's going to be hard to fight. And on the other hand with no physical evidence! Even if a jury finds him not guilty, how do we really know? O.J Simpson?

it is a sad day in the USA when we get just enough information to suddenly think that we know everything just because we see it on t.v. what happen to the rights of this little girl and to this man? I thought we lived in the USA where a jury of our peers would decided if we are right or wrong not a bunch of people who have nothing to do but convict/hang/ and kill with words instead of praying that this did not happen to a little girl. and if it did not then this man will never be the same because of these and many more comments. if he is guilty then let him pay if not then god help him and his chlidren for the life they will have to live to over come this judge of wrong doing on the behalf of jacksonville. When this story unfolds, and the truth comes out, all of you who are convinced of his guilt, will see that just because it's on the news, it doesn't make it true..Women lie....especially mentally unstable women who are in danger of losing their kids......in your minds he is guilty, but i know this man, and if you knew him, you would agree that he could, and would NEVER do what he is accused of doing...You that know his wife, also know that she has got some serious issues...the woman is mentally ill....it's sad to see so many people have already judged this man...those of you who are convinced of his guilt.....will you post comments after he has been cleared..will you apologize...i think not.....innocent people get accused of wrongdoing more often than you think....this is mob mentality..you people are talking out of the side of your neck...your knowledge of the case is limited to what you see on tv...i know all parties involved, and i would stake my life on juan's innocence

It's sad to see that so many of you have convicted this man without any knowledge of the case.... juan was in a custody battle for his kids..he raised that girl(not his own) since she was 8 months old....Think about this for a moment....leticia, the girls mother reports this on the 29th on july..juan is arrestedhat on the 7th of august...9 days after the report....there is no dna evidence...if there were, his bond would have been much higher..what the police have is a statement from the mother claiming abuse...the mother is fearfull of losing her kids, so she is doing the only thig her warped mind can come up with...to make an appaling accusation that she knew ,true or not would damage him forever.....has the duke rape case taught us nothing....people on here are spouting off about how this man should die...he has already been judged by the press, and alot of people in town....The truth will come out, and he will be exonerated...Will those of you screaming for blood,then apologize? no

There must be reason to believe that this event has happened. Even if accusations were made, there must have been some type of evidence to charge him. Our judicial system is better than most people think. He will have his day in court and let's just trust the justice system to do the right thing.

I do not know this man but until he is found guilty he is innocent.If he did hurt this little girl he deserves everything coming to him. However, if he didn't then the person who did hurt her needs to be behind bars.I read a comment posted by darius just because this women was hospitalized in brynn marr does not make hera bad mother and it does not make her crazy sometimes we just break and need a break. My thoughts and prayers go out to the little girl especially because Ihave a daughter her age. If this man hurt his child he needs to be put away for life.

UHH..."ME", another side to the story. He was arrested and charged on NUMEROUS counts. Don't you think that a medical exam which I am sure was completed prior to arrest gives you any and all sides needed. Personally, someone who does this to a child needs to be castrated. Betcha he wouldn't forget his crime while he sits in prison having 3 square meals, watching TV in the exercise room. Oh, and "Mark" the news is only reporting what the POLICE reports and arrest warrants show!

It seems that we as Americans are all tired of cases like this. Something needs to be done, and we should start a petition to be passed in congress with enough public out cry and enough media coverage something is bound to happen. Since we are posting our comments here on WITN's website maybe they would like to kick this petition off with an announcement on their TV station. Something to the effect if you want to protect your kids from sexual assualt, sexual battery (sp?) indecent liberties with a minor....etc. contact us by email and the info should be shared every night on their news programs. The death penalty should be enforced for crimes against children of any ages.

I do believe the Jessica law is now in effect. It should without a doubt be used against this man. The important thing to remember people is the real punishment for this crime if there be no repentance or no remorse for the crime in question.

This is horrible...9 counts? There has to more to this story...after one count of sexual battery on a 4 year old..would the child not be bruised/bleeding/emotionally upset..to say the least.At 4 years old children still need alot of assistance with baths and dressing...I'm almost sure the mother would have seen evidence of assault after each of the 9 times...we are talking about a 4 year old little child(either male of female) this child would have been in alot of distress after 1 time. My heart goes out to the child. I have no respect or sympathy for the man or anyone who protected him while he carried out these assaults. Horrible!

One thing is for certain. If you put this man in general population he will not make it. Not that anyone would be hurt. I make that comment due to the fact that our justice system has become so liberal over the years. Example: the overweight guy who doesn't want to pay for his crimes even after 22 years of incarceration. God figure.

It is sick, raping of any age. Prison is not the answer. The state has take care of him or her then. The person needs help medically. He or she should be demanded to a program and pay for it out of their own pocket. Clearly the person need help. The rapist should also be demanded to pay for whatever kind of help the child need.

Another side to this story? What like the 4 year old was leading him on? I'm also in favor of expanding the death penalty to include crimes against children, sadly its not going to happen. Has the Jessica's Law gone into effect yet? If not, life in prison does not always mean life. Every day there are inmates all over the state who are serving life sentences that receive parole.

this is so sad. makes me cringe to think of this. god bless this poor little child. though he deserves the death penalty - it probally wont happen. if not i hope he stays in jail for the rest of his miserable life - and the biggest male in prison makes him his girlfriend... alot of times it is not good for these men when the prisoners find out what they have done to a child. he will get his just desserts one way or another. i personally hope (he) fries!!

It was just reported that this man was released on bond. I cannot believe with 9 counts of first degree rape of a child, they would release him on $150,000 bond! He will probably be in Cesar's old cabin by the weekend! Editors comment: Our latest facts indicate he was placed in jail with no possiblity for bond, this is from the Onslow County Sheriff's Dept.

does anyone else think that WE are letting these people get away with too much? Is that why it keeps happening? What would happen to these criminals in Singapore??? Thats why they have such a LOW crime rate....wake up people!!!!!

WITN can you provide any real information for this story? Is the perpetrator a US citizen? Related to the child? Past history? Who? What? When? Where? How? These headline-grabbers are worse than tabloids. Please have the decency to follow basic journalism principles when reporting stories and stop the sensationalism!

Unfortunately, the Supreme Court just struck down state laws that allow for the death penalty in child rape cases. According to the SC, execution is too severe a punishment for this crime. I think the only 5 people in the country who agree with this are the ones on the SC who voted this way.

Lets just hope and pry that this child i young enough not to remember later down the road and hope that if they do not remember that no one brings it up. In this case if the child does not remember it could be better in the long run!!! THis is terrible and I agree that we should not feed, clothe or provide helter for him!!

Sadly enough I would say an execution would not be in order. Why do you think you hear stories about this stuff from time to time. Not too many people are afraid of prison thanks to our legal system. I agree with Scott and a previous poster...he deserves the electric chair. Maybe if this was the penalty people would think twice before they hurt innocent little children. God bless this child and the family.

It never said how this man came in contact with this child?? Does he know the family, is he a family member? Why was he left alone with the child? Either way this is so so sad, Iam so sick to my stomach. Iam a young mother of a two year old and I cannot even believe how my perspective has changed, I am very protective in a way I thought I never could. I hope this guy is condemed in he*l forever!!!

In some states the law is anyone having sex with a child under the age of 14 it is a mandatory LIFE with out the possibility of parole. I hope NC has that law

This is so sad and yet so often these things happen..4yrs. old and has to live her life with the terrible memories of this..He should get the electric chair..I wish I was the Judge for cases like this and they would wish the thought had never crossed their minds!!

Why was he originally jailed without bond and then they changed it to 150,000? HE IS ALREADY OUT OF JAIL TODAY! Why the h*ll did this happen? He is facing 50 charges. Hellooooo? Jeeez!
