Wrongly Convicted Man Freed After Serving 18 Years Sued For Child Support

A man who spent 18 years in a North Carolina prison for the rape of a child he never met now faces another trial: a lawsuit demanding that he pay 18 years of child support.

A judge ordered Dwayne Allen Dail released from prison in August after DNA showed he didn't assault the 12-year-old girl. Gov. Mike
Easley pardoned him this month.

Dail hopes to receive $360,000 from the state, based on a law that allows him to collect $20,000 for every year he spent in prison.

His former girlfriend, Lori Michaels, filed a lawsuit on Tuesday in Wayne County District Court demanding that Dail pay support for their son, Chris, who was born after Dail began serving his jail sentence.

The lawsuit was served on Dail in Fort Myers, Fla., where he moved after his release -- and where his son now lives with him.

    I agree it seems as if she got public assistant she would be entitled to nothing for the child.However if she raised the child and worked needing no support from the gov. then yes she should get back child support but in the end whatever happened to raising children without a dollar sign behind it.It seems to everyone talking about this she just wants part of his large settlement from the state.

    My question is how did this woman support her child. If she received public assistance to support this child during his incarceration then she is entitled to NOTHING.

    This man was locked up for 18 years of his life and will never get that back. I cannot believe that anyone could possibly think that he should owe anybody, for anything! Not to mention, the fact that he is taking care of his son, now that he can. Just let the man be, he's already given enough!

    He should've gotten more than 360.000 for wrongly accused and doing 18 years in prison. I wonder is a DNA schedule.He can't win from losing.

    The fact is this woman, presumably, raised this child alone, at least we know she did it without the childs father because he was in jail. Regardless of the circumstances he is still responsible for this child he helped create. Child support is based on physical ability to pay also, he is capable of making money now, and yes, the woman should be reimbursed for raising his child alone. Seemed stranged to me that he got out of jail in August and is now living in Florida, with the 18 year old child! Sounds like family drama to me anyway!

    Guess the old girlfriend saw dollar signs and decided she needed in on the cash. What is this world coming to? Sorriness!! Pure Sorriness! Everyone is out for that Dollar!!!!!! Poor man lost 18 yrs of his life for something he didn't do. Sad, sad, sad!

    If this man had no income for those years, how can he be sued for child support. If child support was never in place then there's no child support to be paid!
