Suspect's Father Files Wrongful Death Lawsuit After Son Killed By Police

A lawsuit has been filed in a 2009 shooting that killed Martin County Deputy Charlie Brown and another man. Two years ago Thursday, Brown was shot responding to a call regarding Jerry Lee Pace Junior. Pace was also shot and killed. An SBI investigation cleared the law enforcement officers and stated they acted appropriately.

Pace's father, Jerry Pace Senior, has now filed a wrongful death civil suit in U.S. district court and is seeking $1 million. He's suing Martin County Sheriff Dan Gibbs, former Williamston Police Chiefs Steve Smith and James Grubbs, and other police officers and deputies.

Pace alleges in the lawsuit that after Brown fired on December 8, 2009, other officers wildly fired, killing both his son and Brown. Sheriff Gibbs tells WITN the SBI told him Pace fired first.

As far as Pace's claim his son didn't get proper medical treatment and therefore died, Sheriff Gibbs said that's not so; emergency personnel tried to save both Pace and Deputy Brown.

    Merry Christmas and Happy New Year Sheriff Dan Gibbs. Once I was proud of you and all your accomplishments. But once you got Sheriff along with other things that you have.... you got above your raising.... One day you will learn what is important and what is not. But if you haven't yet on the door of 61 years of age... I guess you never will. And that is all I have to say.

    As a taxpayer and citizen of Martin County I would like to know how are we going to handle the corrupt cops and the cover ups. I hear too many people talking about this and just suprise to see so many people just stand by and do nothing.

    the truthful fact is charlie brown did fire his weapon.alot of things was brushed under the table, now maybe the truth will finally get out.

      The truthful fact is Charlie DID NOT fire his rifle, it was charged but was on safety and the dust cover was still in place. You only think you know the facts, I was there that day and saw it.

      You are right military mom there are alot of unanswered questions about that day. There have been different stories told about that day. I know it has been reports that Brown was killed by one of his own.

    REALLY!?!?!? This is just too sad. You can tell that this man is the suspects father cause hes just as mental as his boy. How can you sue for wrongfull death when the suspect didnt listen to the commands the LEO's gave him. Had he of dropped his weapon he would not have been shot.....at least that day. RIP Charlie, til we meet again

      Maybe if the LEO's hadn't ambushed him from all sides then he would have listened. And there's an article in the Enterprise about it now with more information.

    Anyone on this site who believes a word of this article has absolutely no clue what ACTUALLY happened that day. After reading the comments it seems that most of the people who are siding with the Pace's know absolutely nothing about that day.

    as a hunter i know you have no control over a rifle with a cell phone in one hand and a rifle in the other .you sould try it.didnt work for me.and pace was talking to his girlfriend when shots started.
