Woman Says She Awoke To Find Man Raping Her

A Halifax County woman says she was awakened to find a man raping her.

Sheriff deputies have arrested Carl Vincent for the attack that happened Sunday in the Littleton area. Investigators say the 44-year-old man from Gaston turned himself in Tuesday.

Vincent, who is charged with second degree rape, is in jail on a $25,000 bond.

    Let's not assume "one thought?"...we don't know who lived in or was visiting her home. Relatives and "friends of the family" committ acts of violence also. Furthermore even if she allowed him into her home, rape is rape. We do not know the circumstances. As for the heavy sleeping...I can sleep through almost anything. Once when my neighbor's house caught on fire I didn't know until the next morning...and that was with all the fire engines, ambulances, screams, etc. Her account is very believable.

    2nd degree rape is when rape occurs without a weapon or injuries to the victim. Hope that helps...

    To sound sleeper, between me and my wife, we are the opposite when it comes to getting up. She can get up easily and is easy to wake up. Me on the other hand, I have had the history of sleeping through the sound of my alarm on a number of occasions. Whenever there is no alarm on and we get up for whatever, sometimes I wake up to her trying to get me up after about 5 minutes. Because of the fact that I am really out when I am asleep, I can beleive that woman as well.

    Where is the B&E charge? the woman wasn't sleeping outside, was she?...the story sounds a little like she knew the guy and that he was allowed into her home already.....

    I believe her. I am a very sound sleeper and I never hear anything. I never know when my husband comes and goes in the middle of the night. He has often said, if someone were to break in to our house and rape me I would never know it. I just hope when I have children I can hear them.

    I thought rape was rape. If she woke up to being raped that meant she did not give consent and it should be first-degree rape.

    To Justice, here is the NC Statute explaining 2nd degree rape-hope it helps. It is a class C felony, absolute maximum punishment is 210-261 months in prison: § 14‑27.3. Second‑degree rape. (a)A person is guilty of rape in the second degree if the person engages in vaginal intercourse with another person: (1)By force and against the will of the other person; or (2)Who is mentally disabled, mentally incapacitated, or physically helpless, and the person performing the act knows or should reasonably know the other person is mentally disabled, mentally incapacitated, or physically helpless. (b)Any person who commits the offense defined in this section is guilty of a Class C felony. (c)Upon conviction, a person convicted under this section has no rights to custody of or rights of inheritance from any child conceived during the commission of the rape, nor shall the person have any rights related to the child under Chapter 48 or Subchapter 1 of Chapter 7B of the General Statutes.

    What is second degree rape? Was it because she was asleep? I don't understand the justice system.
