The first degree murder conviction of an Onslow County man who strangled his wife and buried her in the backyard will stand.
Soyer Moll was convicted in November of 2011 of killing his wife Virginia.
Moll was sentenced to life without parole.
The North Carolina Court of Appeals has now affirmed the conviction.
Moll told jurors he snapped when he found out his wife was leaving him for another man he didn't know anything about and was taking their daughter with her.
District Attorney Ernie Lee reacted to the Court of Appeals decision saying he's pleased that the victim's family was able to receive some degree of justice in this case.
