Suing The President

(NBC News) The tug-of-war between Congress and the White House may be headed to the courts.

Republican House Speaker John Boehner says he wants to sue President Obama for trying to change the law.

Boehner says instead of faithfully executing the law, as the Constitution requires, President Obama is using executive orders to change the law.

"Not only does the President regularly ignore the law he brags about it. It's arrogance and incompetence right down the line," Boehner says.

Minority Leader Nancy Pelosi likened this lawsuit to a childish tantrum.

"There really needs to be an adult in that room of the Republican caucus, I hope the Speaker is that adult. They're doing nothing here and so they have to give some aura of activity," Pelosi says.

WASHINGTON (AP) - Speaker John Boehner says he intends to file a lawsuit accusing President Barack Obama of failing to carry out the laws passed by Congress.

The suit would be filed on behalf of the Republican-controlled House.

Boehner provided no details of the claims to be made in the suit. He privately briefed members of his rank and file on his plans on Tuesday.

Republicans have long accused Obama of selectively enforcing the health care law that bears his name, and doing the same with immigration legislation long on the books.

At his weekly news conference, the speaker said the Constitution makes it clear the president's job is to faithfully execute the law.
