FIRST ON WITN: Charges Filed In Crash That Killed Kinston Mom

Charges have been filed against the man troopers say caused a tractor trailer to swerve off the road and hit a mother and her toddler. The woman later died from her injuries, as did her unborn baby.

Court records show 62-year-old Fred Green of La Grange is charged with misdemeanor death by motor vehicle, along with a traffic violation of an unsafe movement. Troopers say Green was driving a pickup truck that pulled in front of a tractor trailer. The driver of the big rig swerved to miss the pickup truck, but he instead hit 22-year-old Tiffany Smith and her son. The woman was in the parking lot of BJ's Grill in La Grange when the accident happened last Tuesday.

Family members said they thought Smith would survive, but five days after the crash, she died at the hospital. She lost her unborn baby in the crash. Smith's 22-month-old son has been released from the hospital.

The funeral for Smith and her infant son are scheduled for Friday in Kinston.

The woman who was hit by a tractor trailer in the parking lot of a restaurant in Lenoir County last week has died.

The Medical Examiner's Office in Greenville confirms Tiffany Smith has died. The 22-year-old and her two-year-old son were hit by an 18-wheeler in La Grange last Tuesday.

Troopers say a pickup truck switched lanes in front of the tractor trailer, causing it to slam on its brakes. The truck ended up in the restaurant's parking lot, hitting Smith and her son.

The Highway Patrol says the driver of the 18-wheeler will not be charged in the crash, but now that the mother has died they are conferring with the district attorney about what charges to bring against the pickup truck driver.

Family members tell WITN News that Smith went to South Lenoir High School and they thought she would make a full recovery. But relatives say on Sunday the woman's brain hemorrhaged and she suddenly died.

The woman's son, Deshawn, was released from the hospital and is now with his grandmother, according to relatives.

The family says Smith was pregnant and that she lost her unborn child prior to passing away.
