'Fragging' Case Defense Raises Questions

The widow of a New York National Guard soldier killed in Iraq two years ago says she hopes her three-year-old daughter will see justice for her father.

\Slobhan Esposito is frustrated by delays in the case at Fort Bragg of the fellow Guard member accused of killing her husband and another superior officer.

Attorneys for 39-year-old Staff Sergeant Alberto Martinez of Troy, New York, yesterday asked for a new investigation hearing and
new defense lawyers and prosecutors.

Martinez is accused of killing 30-year-old Captain Phillip Esposito of Suffern, New York, and 34-year-old First Lieutenant Louis Allen of Milford, Pennsylvania.

Defense attorneys says Martinez had poor representation at his
Article 32 hearing, the military equivalent of a civilian grand
jury.
