Hearing Set For Army National Guard Soldier Accused Of Killing Officers

.An Article 39-A hearing is scheduled for this morning for a former New York Army National Guardsman accused of killing two officers in Iraq in 2005.

The hearing at Fort Bragg for Staff Sergeant Alberto Martinez is
equivalent to a pretrial motion hearing in civilian court.

Martinez has been charged with two counts of premeditated murder in the deaths of Captain Phillip Esposito and First Lieutenant Louis Allen. Both were members of the 42nd Infantry Division.

Martinez was the first American charged with killing a superior officer in Iraq during the war.
