UPDATE: Victim's Condition Improves After Monday Crash
Daniel Avery was one of two people that survived Monday's deadly crash in Beaufort County.

A man who was rescued from a submerged car on Monday is improving at Pitt County Memorial Hospital.
The hospital says Daniel Avery is now listed in fair condition.
Avery was one of five people in a Ford Mustang that sunk into Cherry Branch Creek Monday morning. Three people inside that car died.
Troopers says Harry Moore, Jr. was driving the car at more than 90 miles per hour. He remains in jail on a $300,000 bond. The Highway Patrol says additional charges are still pending against Moore, but they are awaiting test results from the SBI lab.

One of the victims in the Monday morning car crash in Beaufort County remains in the hospital.
Officials at Pitt County Memorial Hospital in Greenville say Daniel Avery remains listed in serious condition Wednesday afternoon.
Funeral arrangements have not been announced for any of the three victims. Angela Carter's funeral will be handled by Paul Funeral Home of Washington. Services for Rakima McCall and Earl Windley will be handled by Randolph Funeral Home of Washington.
Suspect Harry Moore, Jr. remains in the Beaufort County jail on a $300,000 bond. Troopers have not yet filed any additional charges against Moore.

The man who troopers say was behind the wheel of a car that plunged into a Beaufort County creek remains in jail.
Harry Moore, Jr. was charged with three counts of misdemeanor death by motor vehicle. Troopers say they could file additional charges against the Beaufort County man, who just last week was arrested for DWI in another accident.
A magistrate set his bond at $300,000.
Only one other person survived that crash. Daniel Avery was airlifted to Pitt County Memorial Hospital in Greenville.
Avery's family is angry that Moore could get out of jail on the misdemeanor charges, and be able to walk the streets when he also has a DWI charge.
Relatives tell WITN News that Avery is heavily sedated but responsive to the nurses. They say the man has a broken neck, broken back, broken ribs, broken tibia, and trauma to the face.
The accident happened Monday morning at 11:40 on Cherry Run Road in Beaufort County, close to the intersection of VOA Road.
The Highway Patrol says 21-year-old Angela Carter of Washington and 18 year old Rakima McCall were found dead in the car after it was brought to the surface.
21-year-old Earl Windley was found in the creek underneath the bridge.
WITN will follow up with the Highway Patrol regarding pending charges against Moore, whom they say was driving 90 miles per hour when he lost control on Cherry Run Rd. Monday.

They say 37-year-old Harry Moore was driving 90 miles per hour when his car veered off the road and nose dived into Cherry Run Creek.
The accident happened Monday morning at 11:40 on Cherry Run Road in Beaufort County, close to the intersection of Voice of America.

The bodies of two women have been found in a submerged car after it crashed into a creek Monday morning in Beaufort County. Now rescuers say they found a third victim, a man, dead in the creek.
The Highway Patrol says one of the women killed has been identified as Angela Carter, who was 21 years old and from Washington. Also killed was Earl Windley, whose body was found in the creek.
Troopers say the car's driver, Harry Moore, was arrested last week on a DWI charge in another case. They say charges are pending against Moore in Monday's crash.
The other survivor has been identified as Daniel Avery, while troopers have yet to release the name of the third person killed.
Moore was actually due in Beaufort County district court Monday on several charges of obtaining money by false pretenses and possession of a firearm by a felon.
The accident happened near the intersection of Cherry Run Road and VOA Road in Beaufort County around 11:40 a.m. The Ford Mustang landed it about 4-5 feet of water and was pulled from Cherry Run Creek around 2:00 p.m.
Troopers believe that car was going around 100 miles per hour when the crash happened.
Two people were pulled from the car alive. Those two men were taken by EastCare helicopters to Pitt County Memorial Hospital. Troopers say one of those men was the driver of the car.
1st Sgt. Kenneth Pitts says the car veered off the right side of the highway, struck several trees before landing in the creek.
He says it's believed speed was a factor in the accident.

A slap on the wrist is why so many people are constantly breaking the law, because they are not forced to learn from their mistakes or diliberate wrong doings, as in this case 3 people are dead because someone was careless and thinks he can do what ever he wants, i hope this time he is made to pay for his crime
How do you classify someone going 90 mph as an accident? Did his accelerator/thottle get stuck? Was the driver held at gunpoint, forced to drive fast? I'm not saying there was malicious intent, but the word "accident" doesn't seem to fit. He "wrecked" or "crashed" his car due to excessive speed. If I contracted HIV because I didn't use a condom, would you call that an "accident"? Think about it...huh?
