.A second congressman has asked the Department of Justice to investigate Durham District Attorney Mike Nifong.
New York Representative Peter King urged Attorney General Alberto Gonzales to investigate whether Nifong violated the rights of the defendants. King's district includes family members of accused player Collin Finnerty.
North Carolina representative Walter Jones made a similar request.
But the attorney general's office has declined to investigate, saying that it would be wrong to investigate while the case is ongoing.
Nifong asked to be recused from the case last week. Special prosecutors with the North Carolina attorney general's office have taken over the case against Finnerty, Dave Evans and Reade Seligmann.
All three still face sexual offense and kidnapping charges.
