NC Appeals Court Upholds Murder Conviction For Serviceman's Spouse

The state Court of Appeals has upheld the murder and conspiracy conviction of Michelle Theer in the 2000 killing of her Air Force officer husband.

Theer was convicted in 2004 in Cumberland County Superior Court.

Her husband was Captain Marty Theer, a C-130 pilot at Pope Air Force Base who was shot to death on a stairway at his wife's office. Prosecutors say Michelle Theer conspired with her boyfriend to kill her husband.

Defense lawyers argued that Theer's sexual history had poisoned the jury that convicted her.

Her boyfriend, Army Staff Sergeant John Diamond, was convicted in a military court-martial in 2001.
