An Edgecombe County woman, charged with murder after her 13-year-old stepson died after being tied to a tree, is out of jail.
WITN News has learned that Sandra McMillan posted the required $200,000 bond this morning and was released from jail.
Sandra McMillan pleaded not guilty in Edgecombe County Superior Court in January to child abuse and murder. It was during that hearing that Judge Milton Fitch set the woman's bond.
The judge ruled if she posted bail, she must live with her cousin in Cary and wear a monitoring device. She will be allowed to travel only to her attorney's office.
McMillan and her husband, Brice, are accused of tying up Tyler McMillan overnight for being disobedient last June 10th. Tyler also was tied to the tree the next night, and Sandra McMillan found him unresponsive the following afternoon.
She and her husband were indicted last month. Brice McMillan waived arraignment and has pleaded not guilty to the same charges.

Released on bond or not, the court should have the good sense NOT to let a person who is even potentially guilty of such acts have ANY access to other children until the court knows the extent of guilt. And the court DOES NOT know that yet. Judge Fitch, allowing Sandra to have ANY contact with her surviving daughter (or any children) is beyond stupid. Who knows what that child has endured at the hands of her mother already? It sure didn't work out well for her poor brother Tyler did it!! It just makes no sense. And what about the cousin's neighbors? How would you feel having such a monster moving in next door? Do you think anybody even bothered contacting them to let them know about their new neighbor - so they can keep an eye on the safety of their own children? God forbid, that would probably invade some precious privacy right. What insanity!!!
I can't believe the courts could actually not know these people are gonna be wanted fugatives and running... if they are set free on the street again.unk is correct . what the h.. is going on.
Speaking from experience,I can understand why the McMillians attorney entered a "Not guilty" plea....everyone is entitled to legal representation & the attorney is just trying to do his job to the best of his ability...I'm sure he is not particularly fond of this case anymore than the general public is..and although I do not agree with the Judge, his job in setting bond has NOTHING to do with whether they are guilty or not...bond is set according to flight risk...I,too,hope that both of these monsters have the book thrown at them, but with the reality of overcrowded court dockets, I'm sure a plea agreement will probably be reached...I just hope they suffer in prison at least as much as this child suffered...either way, their lives are ruined...
