There are questions tonight whether a Greenville police officer violated departmental policy moments before a prisoner escaped.

Police say Justin Barnes escaped from an interview room at the police department Wednesday night after an officer left the room to notify a supervisor.

Through an open records request, WITN obtained the police department's policy on temporary detentions. It says officers shall maintain eye contact with prisoners at all times, except for restroom visits.

Barnes, wanted for an armed robbery, is still on the run. Greenville police say an internal investigation is underway into the escape.

71.4.1
TEMPORARY DETENTION
CALEA Standard: 72.9.1, 72.9.2, 72.9.3, 72.9.4, 72.9.5, 72.9.6, 72.9.7

TEMPORARY DETAINEES

The Greenville Police Department does not operate a temporary holding facility. The purpose of this general order is to establish procedures for the supervision, accountability, safety, and security of temporary detainees brought to the Police Department for arrest processing and/or testing of prisoners and detainees. The transporting officer is responsible for the safety and security of persons brought to the Police Department until relieved by another officer assuming responsibility for the individual.

All persons temporarily detained at the Greenville Police Department shall be under the continuous control or supervision of the transporting officer or an officer assigned to guard or process detainees. At no time will any detainee be left unattended. Because detainees are not held at the police department and are only transported here for processing, interviewing, or, in rare circumstance, for a Voice Stress Analysis, there is no formal documentation in logging the detainee’s time here or reason for being in the building. Supervision shall require that sworn Department personnel be assigned to maintain eye contact with the detainee at all times except for restroom visits as previously detailed in this directive.

If at any time the transporting officer or officer assigned to guard a detainee must leave the detainee’s presence, another officer shall be required to maintain eye contact with the detainee until the previous officer has returned. If an officer at the station is not available to remain with the detainee, a patrol officer shall be called into the station to remain with the detainee. It shall be the responsibility of the officer assigned to guard the detainee to secure a replacement officer to remain with the detainee as a guarding officer before the former guarding officer leaves the presence of his/her detainee.

Detainees are not to be handcuffed to any fixed object unless the object is designed or intended for that use. Juvenile detainees may not be handcuffed to any fixed object at any time. Officers are to ensure that male and females are detained separately. Likewise, adults and juveniles shall be detained separately.

Booking/Interview Areas

The Greenville Police Department has designated the following rooms for use in detainee processing, testing, or temporary holding:

· Booking/Processing Room

· Interview Room (Second Floor)

· Interview/Voice Stress Analysis Room (Second Floor)

· Roll Call/Briefing Room (To be used only as a last resort when detainees need to be separated and the above areas are unavailable)

The officer responsible for the detainee will ensure that the subject is provided access to water, restrooms, and other basic needs in a timely manner.

In the event of a fire, officers will remove the detainee from the area following established evacuation procedures. A fire evacuation route is posted on each floor of the Greenville Police Department. It is the officer’s responsibility to maintain control of detainees in the event of an evacuation of the building.

Security

When transporting a detainee to the police department for processing, the arresting officer will use the Sally Port area and secure their weapon as outlined in SOP 71-3-1. When utilizing the booking room with a detainee, officers are to secure their firearms in the lock box provided. It is not necessary to secure weapons when detainees are taken to other areas in the building, but caution should be exercised at all times.

Officers will complete a security search of the room for contraband or weapons prior to placing the individual in the room. All detainees will be thoroughly searched for weapons, contraband, and evidence prior to being placed in the room. After removing the detainee from the room, officers will conduct another search of the room. The officer responsible for the detainee will limit and control access to the room occupied by the detainee.

If a detainee escapes from custody officers should follow the same guidelines as outlined in Policy 71.1.4.

Training

Employees responsible for temporary detainees at any time will receive training in the form of roll call training, field training, or during annual in-service training and retraining at least once every three years. This training will include officer safety issues, dealing with combative detainees, the proper use of designated booking/interview areas, and facility security issues


Original Story

A local man escapes from police custody yesterday-- now they need your help finding him.

Detectives say they arrested Justin Barnes yesterday afternoon, initially for trespassing.

But after further investigation, Greenville police realized Barnes was wanted in the armed robbery of a woman on Paige road in Greenville.

Once at the police station, officers say they left him alone in the interview room, but once they returned, Barnes was gone.

They say the 20 year old is a felon and goes by the nickname of "Shug."

Who thought it would be a good idea to post GPD policy onto a public website. This appears to me to be itself a breach of security. WITN should have better sense than to post this even if whoever allowed them access too it does not. If you don't think the bad guys are reading this and studying GPD polices and procedures think again. How many of you so quick to jump on the GPD when they make an error ever praise them for a job well done? Mistakes happen, some of you folks need to back off.

Please lay off the police, their job is hard enough with out all the bad mouthing, they are human and do a great job especially for the compensation they receive. I guarentee you would not work holiays , hurricanes, and late nights, and do the same professional job they do..police supporter

The guidelines continually state " maintain eye contact" which in itself is confusing. I can just picture an officer getting a work out attemping to maintain eye contact with a suspect who has his head on the table or is looking at the floor. I think the wording needs to be changed to "within eye's view at all times".

They should bring back the old ball and chain. Very simple low cost technology. Whats cheaper $25 for a few pounds of cast iron, or paying a couple dozen officers to search for this little punk.

It amazes me that there are still so many people out there that don't seem to realize that the police are constantly scrutinized by people who don't know anything about our jobs, AND by people who act like they never make a mistake at their job.Maybe if they posted stories everytime an officer did something good, it would help with this mentallity, but that will never happen. Mainly because its not interesting to the general public.

If the policy states "officers shall maintain eye contact with prisoners at all times, except for restroom visits", the officer clearly violated the policy. I would like to know what the policy states is the consequences of an officer that does not comply with this policy?

Is this story even necessary, seems to me not. If it had to do with informing the public of a grave danger rather than taking another unessary jab at our law enforcement, then it would.

Okay, a suspect escaped. Obviously a mistake was made. Here's my 2 cents worth: Kathy, is it fair to paint all GPD officers with the same broad brush because of one error? Have you actually met and spent time with each individual GPD officer to enable you to make such a statement ? Dwayne,you made the obligatory doughnut joke. What about the scores of officers who eat right,keep fit and get mad when they see their less-conscientious co-workers indulging in such behavior ? Bottom line: We mostly only ever hear about the few bad cops. We never hear about the MAJORITY of them that serve with honor and integrity,and at great personal sacrifice. Very easy to stand in judgment of the police when you have the luxury of not having to face what they do. A mistake was made here but that does'nt justify condemning the whole force or even the officer responsible. Everyone messes up sometime. If you've never been a police officer, then stop trying to tell the police how to do their job.

WITN, it really gets old that you constantly report on the negative parts of this city and our Greenville Police Department. This station contributes to the division between the community and police officers. Way to go. Here is an idea, why don't you report on the ACCOMPLISHMENTS of the police department. You guys/girls only highlight mistakes made and none of the great things they do for this city. Let's have a little class hmm?

The police are not suppose to screw up people! We have to hold then to a higher standard b/c they are suppose to be PROTECTING us. That's just the way it is. They have to take some responsibility. If I screw up at my job, I own it. They should too. If they screw up, society is put at risk. We are suppose to be able to count on them to take care of us and protect us from the bad guys. How can we do that if they are gonna let the "bad guys" walk right out of the jailhouse??? Stop making excuses for them.

They need to fire everyone on watch. They did the hard part of detaining him. Why would they leave a suspect unmonitored. This is just crazy.

Ahh the comments of the people caught doing wrong and want to talk trash. Remember that the ones trashing the police are the ones that get caught and lay blame instead of the novel idea of taking responsibility. It is amazing that if the police patrol aggressively and enforce the law they are pickingon the students, and if they are not enforcing the laws they are doing nothing. Maybe if they could handcuff the this criminal he would not have got away. No excuses though, he should have been watched. Depends on who the officers are if they will be disciplined though. Depends on if the chief likes them.

Ease up off the police. Considering how many arrests they make, one is bound to faulty. Yes, the officers messed up. How many of you posting these condescending comments have screwed up at YOUR job?? Everyone messes up! It just so happens that when the police mess up, their mistake is on public display. GPD staff are human, just like you and me, and they are going to make mistakes. Personally, I appreciate what they do for our city. So what if an officer makes a mistake every now and then? Cut them some slack!! Would you want your mistakes put on blast for the entire city to know and comment on?

From what I know Greenville police didn't put the press release out until 11:30 pm that he had escaped. If they REALLY wanted to captured him don't you think they would have alerted the media so it could be on the eleven o'clock news and in the newspaper as well? Do they even have a public information officer at GPD??? Remember the pirate theft...they kept that quiet for four days. What else is being swept under the rug?

I wonder too how an inmate just up and walks out of a police station and no one notices? Is anyone paying attention? And, why was he left alone in an interview room? I have family members who are upstanding officers in law enforcement and I support them. But, come on!!!????

Kathy, when was the other black eye? These things happen. GPD makes THOUSANDS of arrests each year, most without incident. The "black eye" should go to the court system for allowing yet another felon to walk among us and victimize yet another person.
