Not Guilty Verdict for Former ECU Player

The verdict is in for a former East Carolina basketball player charged with rape.

It took the jury just a little more than an hour to find Garth Grindley not guilty. Grindley was charged with second degree rape, sexual battery and assault on a female. The jury found him not guilty on all three charges.

The state argued Grindley used his size to force himself upon his victim. She testified he held her against her will and raped her in his apartment two years ago. But during the course of the trial, the defense argued the state did not present physical evidence such as a rape kit or 911 tapes to corroborate the victim's testimony.

Grindleys' lawyer told the court his client and the accuser had a prior romantic relationship, and he believed the intercourse was consensual.
