The family of an off-duty police officer killed while using an ATM in Florida is suing Bank of America, claiming negligence.

Alfred Gordon's estate says the Charlotte-based bank failed to provide proper security at its outdoor, 24-hour automated teller in Orlando. A Bank of America spokesman declined comment, saying the company doesn't discuss pending litigation.

Also accused is the company that owns the bank land. Gordon's family says there were no security guards, proper lighting or cameras.

Two teenagers were indicted on murder charges in October, days after Gordon was killed.

Why use an outside ATM at night, alone w/o any security? There are plenty of ATM's available inside almost every local service station or hotel.

SUE! this is like a easy ride for money. SORRY FOR HER/THIER LOST! suing the bank for negligences. Why was he at the teller/bank? I can not see a lawsuit in this case. If he would've had a heart attack and no one found him in time (at the same teller) is that negligences? SUE THE TEENS WHO PULL THE TRIGGER! Each time I play the lottery and lose I want to go off, but not sue.

I service ATMs after hours. I carry my own security... Smith&Wesson. This is tragic for sure but a police officer should know the risk and be armed at all times.

This is so unbelievable what kind of things people can sue for these days and actually win. I'm fat so I'll sure McDonalds, my cousin died from smoking all his life so I'll sue the cigarette company, and now this. I've seen plenty of banks that have no security guards or anything of the sort. You can't blame a bank for someone murdering another person at an atm. Just say they had've had a security guard and he was killed as well..what would sue for then...not having 2 or a group of security guards, or the family of the security guard would sue the family of the guy who was at the atm b/c he died trying to save his life. We have some real dumb people for even coming up with this kind of suit, and dumb judges for actually letting them win.

If you don't want to work then SUE someone for looking at you wrong or maybe they brushed up against your arm when passing by you. The laws in this country need to change but how can they when it is lawyers making the laws? Lawyers are the winners.

WOW, in a society of sue happy people, why is it everyone elses problem or fault. Bank of America should sue the Lawyer for bringing such charges. SUE HAPPY AMERICA, THE ONLY PLACE YOU CAN SUE SOMEONE FOR LOOKING AT YOU THE WRONG WAY OR BREATHING THE WRONG WAY -
