Late Wednesday afternoon, a Superior Court judge threw out a plan to hold a new statewide election in North Carolina's disputed Agriculture Commissioner's race.
Republican Steve Troxler appealed an order by the State Board of Elections that a new statewide election is needed to resolve the race. Wake County Superior Court Judge James Spencer told the State Board of Elections to create a new solution in light of sworn affidavits of displaced votes in Carteret County.
Troxler leads Democrat Britt Cobb by more than 2,000 votes from more than three million votes cast on November 2 of last year.
