Witness testimony began Wednesday in the murder trial of a former Camp Lejeune Marine.

Authorities say Gary Hayes shot and killed Odell Foster outside the Bayside Restaurant in Havelock in April 2008.

Both the prosecution and the defense grilled witnesses on what exactly happened on the night of April 25th 2008.

Carlton Nolan says he saw a black Cadillac pull up and three gunshots come from the car.

He said he checked to make sure he wasn't shot and then left the scene.

Havelock Police say they were parked across the street and stopped the car shortly after the shooting.

25-year old Gary Lamont Hayes is expected to testify next week that he pulled the trigger and shot foster three times.

Hayes' lawyer Wally Paramore says his client acted in self defense.

Moises Rodriguez plead guilty in the case last year and has been released.

He is expected to testify against Hayes.
