Court Appoints Lawyers For Duke Cop Accused Of Rape And Sodomy
A Duke University police officer facing rape and sodomy charges involving an Alabama woman has been declared indigent. Investigators say they found a whip, handcuffs, and other sexual bondage items in the suspect's car.

A Duke University police officer facing rape and sodomy charges involving a Dothan-area, Alabama woman has been declared indigent.

District Court Judge John Steensland appointed Dothan attorney Valerie Judah to represent Webster Delenn Simmons on Wednesday on first-degree rape and first-degree sodomy charges.

Houston County Sheriff's detectives arrested the 37-year-old Simmons on Monday on charges he bound and gagged a woman as he sexually assaulted her over the weekend. Simmons, of Rougemont, N.C, remains held at the Houston County Jail in Alabama on a $120,000 bond.

Investigators say they found a whip, handcuffs, and other sexual bondage items in Simmons' car.

The victim claims she woke up during the rape, was handcuffed and had a gag in her mouth.

“This is not the type of rapes and sodomies that we commonly see with this type of bondage and this type of material that have been used during the commission of the rape. So it does disturb us, it makes us wonder if this individual has committed these types of crimes anywhere in the United States where he may have been,” said Houston Co. Sheriff Andy Hughes.

Duke University Police Chief John Dailey told the Dothan Eagle that Simmons had been placed on paid suspension.

paid leave only means that he gets to use his vacation time to get a check. Cops aren't on salary, he doesn't get his regular pay unless he is actually working.

I guess after the lacrosse debacle, the administrators at Duke don't want to make any hurried assumptions that their protector of the campus community might be a little off his rocker. But at least it is not state money they are flushing down the toilet.
