Tuesday's double fatal shooting in downtown Greenville raises questions on how the suspected gunman will be charged.
Pitt County District Attorney Clark Everett says in a situation where a gunman shoots a target other than their intended victim, the shooter can be charged with an array of offenses. Everett says the scenario is called transferred intent.
Depending on the details of the crime, the suspect can be charged with anything from first degree murder to involuntary manslaughter.
Greenville police are looking 32 year-old James Richardson in the deaths of ECU student, 21 year-old Landon Blackley, and the manager of the 5th street Michaelangelos Pizza, 28 year-old Andrew Kirby.

Drew Kirby was more then just a pizza maker, to most that's what everyone knew him as, but to the real friends and family that knew Drew like I did, considering that I worked for him are all taking this situation pretty darn good for what has happend, Andrew Kirby was the type of guy that you couldn't hate for anything, always smileing and always putting others before him. It's such a shame to have something like this happen, but it did, thats everyday life. He will be forever missed and never forgotten, Drew "your my boy Blue" and you will always be missed! Now time to sit and play the waiting game as to see what is going to happen to MR. Jason Richardson, I hope that GOD strikes down with all his might upon you and you dont even get a choice as to what happends to your life. You made the decission to take someone else's life, Now you have to live with that untill your time is up. And I feel that wont be far ahead at all, RIP: Andrew Kirby & Landon Blackley!!!

I hope this guy is brought to justice soon... Not to worry the judge is going to throw the book at him! Good! Who is he to take matters into his own hands and play God by taking these two innocent lives. May God have mercy on your evil soul.

I'm with you Lynn/Kinston Why should this guy be tried for anything less than 1st Degree. He had an opportunity to leave, to not get his gun, to not shoot two random people. I realize in this case if the victims had been armed it would not have mattered, however, if someone had been then him being on the loose may not be an issue. Thank the NC legislature for not allowing passing bills like the Castle Doctrine which allows you to shoot someone who enters your house with intent to do you and your family harm. They must be in the house, they must be armed and YOU can't have an avenue of escape! A person with a CCW is not even allowed to carry his\her firearm into a resturant that serves alcohol thanks to Deborah Ross stalling the bill in the Judiciary I committee. The law already prevents anyone who consumes alcohol in a resturant or elsewhere from CCW! The law abbiding citizens will be defensless and the killers will have the weapons! NC & Nation needs to stop the criminals not US!!!
