A grand jury in Onslow County has indicted the former Belhaven police chief and his ex-wife on murder charges.

George Hayden and Vickie Babbitt were arrested last year for the 1972 murder.
The two are charged with first degree murder and conspiracy to commit murder for the death of Marine Sergeant William Miller, who was Babitt's husband and the time.

Assistant district attorney Ernie Lee says they will be arraigned during the week of April 20th.

It's fascinating to read the 40 watt bulb Constitutional Law experts trying to remind us all of the presumption of innocense. As to matters of law, this is a right the state is bound to protect. It was never meant to restrain people from forming and expressing opinions. The Constitution is about restrictions on the State, not people, and people have a right to believe these people are guilty as sin, and to presume from this from the weight of events - yes they have the right to be wrong, as well. If they eventually serve on a jury, the defendants have a right to make a case for change of venue, though if people were taught basic civics any longer a potential juror out to be willing to suspend their opinions until charged with weighing the facts. Are prosecutors suppressing evidence? Yes, that happens, a lot, and like plea bargaining, needs reform. What needed more is for the legislature to adequately fund Justice and Public Safety.

If beliefs and accusations proved a person was guilty, If opinions, gossip and revenge proved a person was guilty, If an arrest proved a person was guilty, If an arraignment proved a person was guilty, If a probable cause hearing proved a person was guilty, If a bond hearing proved a person was guilty, If an indictment proved a person was guilty, If a discovery hearing proved a person was guilty, If another arraignment hearing proved a person was guilty, Then where is justice? Where, in the process above, has the accused been heard and judged by a jury of his/her peers? Where are the rights guaranteed to all citizens of this country by our country’s constitution?
