If you are on a bicycle you ARE traffic. There's not enough info in this story to conclude anything.

From the plethora of information released by LEO on this wreck all we know is the cyclist wasn't killed. We don't know direction of travel, location in the lane of travel, or anything except that the cyclist wasn't killed(which is a good thing). And by the law "out in traffic" is where bicycles and their riders belong, bicycles are vehicles in all 50 states and DC even if sometimes LEO are loathe to admit it, they have bias just like about 45% of the rest of the citizenry. Bicycles are vehicles and have a right to the lane of travel if required for their safety.

@ ROBH...I have to agree and unlike other's,I believe you have just as much right to assume (which I did not see) or comment as the next person. It's funny how someone is always trying to tell another what to think...go figure!

To RobH- Let's not jump to conclusions and assume the bicyclist was out in traffic. Granted, there are plenty of people in this town who ride bikes and do not obey any of the laws, but there are also plenty of cyclists who DO, and are still hit by careless drivers. Let's wait before we assume who is at fault here.

Jail time for Hit and Run and/or Vehicular Manslaughter seems to trump driving. So keep your eyes on the road and off the cell phone.

Bike versus car car always seems to win. If you are on a bike you may want to stay out traffic
