He's already spent 20 days in jail, now a former Richlands ice cream shop owner will spend another 20 behind bars for violating his probation.
50 year old Ernest Van Cooney was in court Tuesday afternoon, after being found in criminal contempt for violating his probation.
Van Cooney pleaded guilty in April to sexual battery and assault charges, he received a 20 day jail sentence and three years probation.
Tuesday, Van Cooney asked the judge to let him serve an active 120 sentence instead of probation, siting he would rather serve jail time so he can move out of the state.
The judge disagreed with Van Cooney request.
He is to finish his probation after his 20 day sentence, and will be on the sex offender registry for 30 years.
