Man Shot After Burglary

An Eastern Carolina man is recovering from getting shot after lawmen say he found intruders in his home.

Halifax County lawmen say a man and his friend returned home overnight to find lights on his house on Little Deep Creek Rd. Lawmen say he wasn't expecting lights to be on, since he had turned them all off. They say he was also surprised to find his front door locked, since he had left it unlocked.

Lawmen say the homeowner went to the back and found five men running from his home. When the homeowner went to run after the intruders, detectives say one of the men shot the homeowner in the leg.

The homeowner's friend heard the gun and called for help. Sheriff's Office bloodhounds from Tillery came in to track the scent of the intruders, but they got away.

Emergency crews took the homeowner to the hospital where he is being treated for a gunshot wound.

    I agree with you MrT but the law states you cannot. I repeat you cannot shoot someone for just trespassing on your property. You can only the law states if the trespasser is immediately threating you death ( Is showing a gun,knife etc )for serious injury,or sexual assault.

    You can thank attorneys for how screwed up the laws are now.If you catch someone on your property after dark with out permission, you should have the legal right to blast him!Period.

    Hi Alex - You are right. If the second amendment had been repealed when it had out lived it's intended purpose this incident would never have happened. Yep then only the criminals would have the guns. They could care less about the law.

    What I see hear the people with the NC Conceal & Carry permits would not have confronted the robbers,and would have called the police. The ones without the permits would have shot the robbers. I guess it pays to know the laws.

    Because of the second amendment and the nra these criminals were well armed. If the second amendment had been repealed when it had out lived it's intended purpose this incident would never have happened.

    I also have a carry permit. Home owner did not know they had a gun. If he did I do not think he would have chased them unless he wanted to get himself killed he was unarmed. He should have called the police. No proof his life was in danger. A gun was never shown at the time of the robbery. He was outside the home.

    Hi - RobH your NCGS 14-51.1 is worded right,but your belief must be based on Facts Real Facts. He was outside the crime scene ,and many feet away from it he personnally was not in danger. If Mr. Home owner charged the house and played Rambo with a gun and started shooting. An lawyer would now say Mr. Home owner is now the aggressor,and using excessive force,and his life was never threatened. If he killed one of those robbers RobH he is going to jail. His life was never in danger even if his property was being stolen. He put his own life in danger when he confronted the robbers. He should have called the police. Lock your doors people.

    Thats you house, your land and your property...get the hint? It is a good idea to take a class, learn the law and then be a good shot when the time comes. An Eye for an Eye would stop all of these shootings and the crime rate would drop! RobH, there is more to the law but your right. They key to it: You MUST feel that your life was threatened...I found that the law is like the can read one thing but you have to read it all to fully understand. As for me, I will protect my life and my property. Yall take care and be safe!
