Troopers Decide If Charges Will Be Filed In Child's Death

Highway Patrol Troopers say they do not plan to charge the driver who struck an 8-year-old boy as he ran across the highway.

The accident happened Saturday on Highway 41 in Beulaville in Duplin county.

Troopers say Malachi Davis ran in front of a car, driven by Rayburn Holmes.

Troopers told the Jacksonville Daily News, a witness confirmed it was a tragic accident.

Davis died at New Hanover Regional Medical Center from his injuries.

    my prayers and thoughts are with the family for the loss of the child, also my prayers are with the driver of the car,because i know if it was me, i don't know i could deal with hitting a child, even if it wasn't my fault. God bless both families.

    Unless there is something more involved than I have seen, how could the driver be charged for any wrongdoing?

    To Hmmmm? : In a case as public and sensitive as this, most agencies would collect all the facts and present them to the DA for review. The DA will say if they would or would not prosecute and then the agency will go from there.

    The death was tragic, no doubt but the streets are for cars and the child also swerved into the oncoming traffic. How can you file charges??!!!!

    The headlines lead down one path. But the full story tells it differently. Just wondering does the NCHP decide or does the DA and a grand jury decide ? I do not understand?
