UPDATE: Mistrial In Case Of Man Accused Of Trying To Kill Woman

A judge has declared a mistrial in the case of a man accused of trying to kill a woman.

Brian Garrett of New Bern was charged with attempted first degree murder, first degree rape, two counts of first degree sex offense, first degree kidnapping and robbery with a dangerous weapon after the attack on a woman at the Windy Trail Apartments.

District Attorney Scott Thomas says the evidence of guilt in the case is very strong, and that the case will definitely be retried.

Jurors began their deliberations Wednesday and told the judge they were deadlocked after two hours of deliberations.

They returned this morning at at 10:30 a.m. the jury foreman told the judge they remained deadlocked 10-2, in favor of guilt, but there was not going to be anything that would change the two jurors minds.

No word yet whether prosecutors plan to retry Garrett or not.
