Havelock Police: Driver Will Not Be Charged In Fatal Bicycle Crash

No charges will be filed in the death of a bicyclist hit by a car in Craven County earlier this month.

James Carbaugh of Havelock was killed May 12th while trying to cross Highway 70 on his bicycle. Robert Murray Junior was the driver who struck Carbaugh. An investigation by the Havelock Police Department showed no negligence, excessive speed or vehicle deficiency on the part of Murray.

A toxicology report showed Carbaugh's blood alcohol level was .38 which is more than four times the legal limit to operate a bicycle.
