NEW INFO: Man Charged In Havelock Police Shooting Goes To Court

A man who is charged with shooting three Havelock police officers Thursday afternoon says he plans to represent himself. This as one of the officers is now back on duty.

Richard Berry went before a judge this morning in New Bern on three counts of assault with a deadly weapon with intent to kill inflicting serious injury.

The 60-year-old told the judge he did not understand the charges and that he plans on representing himself.

Lt. Brian Borton, Sgt. Jim Fahnestock and Officer Loren Boone were injured as police say they were trying to subdue Berry. Officers say they were called to the man's home on Webb Boulevard about a man with a gun.

Sgt. Fahnestock remains at CarolinaEast Medical Center after undergoing surgery on his hand Thursday night. Police say Lt. Borton returned to duty today, while they expect Officer Boone to return to work next week.

District Attorney Scott Thomas says all three officers were shot in the hand. He says Berry was recovering from a previous surgery and was not injured yesterday.

Thomas says they are requesting a safe keeping order for the man, asking that he be sent to a Department of Correction medical unit in Raleigh.

The D.A. says Berry has expressed to jailers that he wanted to harm himself.

The 911 call was made by a woman in Berry's house who heard an initial shot, according to Thomas. Officers at first say they believed Berry might have been trying to harm himself.

Berry's next court date is March 1st.

has been charged with 3 counts of assault with a deadly weapon with intent to kill inflicting serious injury accused of shooting three Havelock police officers Thursday afternoon. Berry's first court appearance is scheduled for Friday.

The spokeswoman for the City of Havelock Dianne Miller said Sgt. Fahnestock with the Havelock Police Department was still in surgery just before 7:00 p.m. Thursday after being shot while checking on a call about a man with a gun in a home.

Lt. Brian Borton and Officer Loren Boone were also shot and were treated and released from the hospital.

Three Havelock police officers were shot after police received a call about a man with a gun in a house.

Havelock police say the officers were transported to CarolinaEast Medical Center with non-life threatening injuries. The man with the gun, identified as Richard Berry, was also taken to the same hospital.

Authorities confirm that one of the officers was shot on the hand and that none of the Havelock officers fired their weapons.

They have been identified as Lt. Brian Borton, Sgt. Jim Fahnestock and Officer Loren Boone.

Havelock spokeswoman Diane Miller says Sgt. Fahnestock is in surgery after being shot in his left hand. She says the other two officers have been released from the hospital.

A veteran Havelock officer says it's the first time an officer has been shot in the city in his 30 years with the department.

Police say it started around 12:20 p.m. when they responded to 407 Webb Boulevard. Police say they immediately heard a gunshot and tried to enter the home. They say that's when Berry confined himself to a rear bedroom.

Police say after an additional gunshot was heard, officers tried to enter the room and after a short confrontation, Berry was taken into custody.

Authorities say the 60-year-old Berry--who has had some minor issues with them in the past--was injured, but at this point police will not say how. District Attorney Scott Thomas says charges are pending against Berry.

Berry is listed as living at the house.

The State Bureau of Investigation is at the scene and is assisting with the case.
