Coast Guard officials have recessed hearings into the sinking of a scallop boat off the New Jersey coast to give the boat owner time to get a lawyer.
Roy "Capt. Fuzzy" Smith Sr., who lives in Pamlico County, made the request before he was called to testify Wednesday. Smith said he doesn't want to get sent to prison for something he didn't do.
Two of Smith's sons were among six crewmen who died when the Lady Mary sank off Cape May on March 24. Only one crew member survived.
Smith asked questions of Coast Guard officers and enlisted ranks who responded to the sinking when the hearings began on Tuesday.
There's no word when the hearings would resume.
