Sheraton Atlantic Beach Facing $1.3 Million Lawsuit

The Sheraton Atlantic Beach in Carteret County is facing a lawsuit, to the tune of $1.3 million.

The hotel is owned by GR&S Atlantic Beach Hotel LLC.

The company is being sued by Cotton Commercial USA, a Texas based contracting company that is authorized to do business in North Carolina.

The lawsuit alleges Cotton was contracted to do emergency restoration and construction work following Hurricane Irene in 2011.

Cotton alleges it was not fully paid for the work. It is asking for $1.3 million and interest on the unpaid fees, as well as attorney fees.

Cotton has asked for a lien on the Sheraton Atlantic Beach and is asking for a jury trial.

The hotel has been closed since Hurricane Irene. The hotel website states “the anticipated reopening date is August 1, 2012.”

WITN contacted the hotel and was told no one in management was available to speak with us.

According to the NC Secretary of State website, GR&S Atlantic Beach has its principal office in New York. We called the New York phone number for GR&S listed on its annual report filed in North Carolina, and we were told that no one would have comment on the matter.
