The latest from the investigating trooper is that the driver of that dump truck is charged with misdemeanor death by motor vehicle.

Highway Patrol has still not released the names of the driver or the victims.

Sgt. Scott Hemby says the accident happened around 9:15 a.m. in Lenoir County on Highway 258 near Pleasant Hill Road.

Sgt. Hemby says a dump truck crossed the center line of the highway and struck a Honda Accord, which the two victims were in.

Multiple fire departments responded to the scene and a portion of Highway 258 was closed while crews cleared the scene.

Troopers say they did take a statement from the driver of the dump truck but are still working to determine exactly what happened.

"So right now, we're just trying to figure out what happened to cause him to go left of center, but right now, that's what all of the evidence is telling us, so we're just trying to piece those things together," Hemby says.

He also says that a bystander at the scene tried to give the young child CPR but both the toddler and the driver died at the scene.

The driver of the dump truck was taken to the hospital for injuries.
